I think Josh might walk. The police know Megan was driving but they can't prove it. They also can't prove Josh was driving and only charged him as an intimidation technique. If Josh calls their bluf and goes to trial there is a good chance he will be found not guilty.

If Josh admits that Megan was driving, she would almost certainly go to jail due to her extensive criminal record and suspended license. However if Josh takes the fall for Megan, he may get off with a fine depending on his own driving record. Megan has already killed one person, albeit unintentionally, with her driving. She seriously needs to get out from behind the wheel.
