SafeRide is likely a legitimate business as it stands under Fairfax County code (note: for-hire (taxi) companies are regulated on the local vs. state level). Loose interpretation of the law suggests SafeRide is exempt based on the current definition of what a "taxi" is. There are no other applicable laws in Fairfax (or anywhere else in Virginia that I've researched) that prohibit SafeRide from operating.
Having said all that, it will be interesting to see what regulation could come to light should this type of business model succeed in any scale. SafeRide is definitely walking a legal tightrope, although worst case I see them eventually being regulated the same as for-hire Taxi companies (big whoop, just some $$, paperwork and 2 year clean driving history).
The topic of insurance has already been beat to death, in Virginia SafeRide is fairly safe in this regard (even if the customer's vehicle isn't insured). The customer is definitely opening themselves to some element of risk, but SafeRide isn't obligated to pound that into the customer's face. I also doubt they are dumb enough not to have consulted professional legal help on these issues.
I personally don't find anything wrong with the business... assuming they operate in a legal and transparent manner. Are they in it for the money more than keeping drunks off the road? Probably... is it doing more harm than good? No. Let a guy make a couple bucks.
