How do I leave my wife, who I have a child with, who has serious mental disorders? She literally tried to kill herself one time a few years back while me and my child were asleep in the house.

Honestly? Just leave. Make sure you file for separation first, otherwise it could be classified as abandonment. But if you want to get custody, you'd better have some evidence to back yourself up and be prepared for a long, long battle.

Make plans to move far far away. It may take weeks or months, but get your ducks lined up in a row. Look for jobs across the country. Secure a job. Secure a place to live. Arrange all moving necessities. Then pick a day when she is gone all day and make that your day to move. Also, NEVER look back.

Might be a good idea to change your name too.

My only other solution is grow a pair of nad's and tell her you want a divorce and follow through with it.

No such thing as "legal seperation" in VA so what would he file for???

OP, you need to document her actions and make the case that she is a danger to herself, you and your child. If you can document it, then you can walk away and file for a divorce after you have been living apart for 1 year. (no kids is 6 months)

The one year usually starts at the time that one of you move out of the shared residence but in FFX County you can claim that you were 'no longer living as man and wife' even if you still lived in the house with her - this is due to the known cost of living in this area. The stipulation is that you will need a witness to testify that you were in fact not 'living as man and wife'.
