What is the penalty for false Police report in Virginia?

Be advised that it is a crime to make a false police report. Anyone found to have submitted a false police report will be prosecuted under the authority of Virginia State Code, Section 18.2-461, which shall be punishable as a Class 1 misdemeanor. Maximum possible penalty is one year in jail and/or $2,500 fine.

Filing a false police report can lead to multiple criminal consequences. Many states call this charge "false report to a peace officer." It is one of the few types of speech that is not constitutionally protected. Lying to a law enforcement officer can result in a criminal conviction.

Minor infractions, like lying about a misdemeanor offense, usually results in a similar misdemeanor charge. Lying about felony offenses can result in felony level charges. Many false report charges come with severe civil penalties. Defendants, like runaway brides, have not only been given stiff probations, they have also been ordered to reimburse communities that expended funds to deal with the crisis created by the false report.

Filing a false report can also result in a separate civil suit. If a defendant falsely accuses someone of crime and the claims are unfounded many times a defendant could find themselves defending an expensive civil and a criminal suit at the same time.

The bottom line is, despite how desperate your situation is, filing a false police report is not the answer and doing so can have long-term financial and criminal consequences. Lying to the police and exaggerating the truth is never worth it.

Subpoenas are usually used for a person who's reluctant to testify. So for Eesh to even try to get involved with the Papa John's case and call the police on Lizzie last night shows he is guilty of something and is trying to intimidate her into either not testifying or lying for him.

Reading over this thread really shows how many people are ignorant of how the law works. You know that in some murder cases all it took was another person's testimony to put someone away? This isn't even a murder trial, so it'd be much easier.


Just because Lizzie and Eesh were friendly doesn't mean she can't testify against him and that doesn't mean she can't bring forth her own case against him if she'd like to, having her family as co-plaintiffs would help her case like the Moreno's are doing.


There are many cases where actual ex-lovers were stalked by their partners and won cases against them, this is no different except they weren't an item. So as for their stalking together, it's not illegal to go by anyone's home. When you start damaging property or tresspassing is when you've comitted a crime. I haven't ever heard of anything illegal happening while the two of them were together. It seems crime only takes place when Eesh is on his solo missions. This is most likely because Eesh was afraid of this very thing happening.


So to anyone who's been trying to say she has no case, because she has stalked or harassed too, you're very incorrect, just like you were incorrect about her being impeached as a witness for being friends with Eesh. Whoever felt stalked or harassed would need to spend a bit of money to sue Lizzie but I won't go into why that's a humorous idea.

I don't remember exactly when I posted it. However all the threatening calls began two weeks ago. Then the visit of the drive by with pictures happened last weekend on Saturday around 8:30-9 am.

You can't plead insanity to a civil suit. The rule is that an insane person is liable for his torts unless he is incapable of entertaining requisite specific intent. As stated over 120 years ago in Williams v. Hays*:

Lizzie literally holds Eesh's life in her hands. She has him by the balls and he tried to interfere with her own case before he found out this was Megan's doing. It went great today. eesh's contacting of Katie was indeed deemed as "Witness Intimidation" and that carries yet another charge. Unfortunately this went on for 3 hours and I missed my appointment with my lawyer to give her information on eesh to pass along to Katie's lawyer but we've rescheduled for later in the week.

eesh's lawyer cross examined me and asked me if I "took cocaine" when I left for recess and went out to speak with the Moreno family LMFAO!

What kind of lawyer asks that? I asked him "Are you going to write to the jury in this case too"

EVERYONE had a good laugh with that one! He wanted to try to bring up my credibity. Haha. I have no reason to lie on eesh. I'm getting nothing out of this and I made sure eesh knew how wrong he was when he said I was getting "free legal cousel" for my case.

Most to eesh's lawyers questions. I held it together until he started asking questions that didn't pertain to the case at all. I got frustrated and was just in disbelief at how odd and irrelevant it all was lol I had to bust out laughing!

It might have been tougher if he had a different lawyer, but, if your not lying or trying to play an angle, then there really is nothing to fear. Its just an intimidating situation.
