Hi quick question,

Do any law firms in this country operate on a no-win-no-fee basis?

how do you instigate an employmeny law claim if you cannot afford a lawyer?

Many firms work on contingency.

If your claim is extremely strong and can prove lucrative, an attorney MAY consider working on a contingency basis.

What is the nature of your claim - discrimination, wrongful discharge, hostile work environment, etc?

If it is discrimination, you can go to a FEPA or EEOC.

I'm sure there's some charity lawyers who do pro bono work, but almost every lawyer says "yes" to these two questions before taking a client:

1. Can I win?
2. Can I make a lot of money?

You could represent yourself, but that's a really dumb idea.

What do you need the lawyer for? If you think you were fired unfairly or something, there is one thing you must remember before even thinking about talking to a lawyer: Virginia has "At-Will" employment laws. Basically, it says that either party (you or your employer) can terminate employment at any time, for any reason, and it's completely legal.

Unless, of course, it violates any other applicable laws, such as discrimination or harassment. Then, you could easily get a lawyer to file a lawsuit for you, so long as you can provide sufficient proof.

I understand the virginia laws, but my severance paperwork which i have not signed states Georgia law as the one it goes by, as that is where the head office is, although i never worked there, only in DC and VA

What are you hoping to get out of it if the paperwork said VA law controlls? Other than that, are there problems with the serverance package? Are you being discriminated against, etc? In your mind, how much is your claim worth?

How will it effect the amound and nature of your severance? I understand you want to be careful you are not getting screwed, but I am failing to see a big settlement out of this.

There is no obligation for them to keep a direct line of communication open with you once you have been severed. Doing so would only complicate matters. They are entitled to keep your personnel records for as long as their policy states. Most likely, they have a policy to keep this information about your employment private unless there is a court order to release.

If you don't sign the severance agreement then the agreement that any dispute is covered by GA law doesn't apply unless you signed an employment contract and that clause was in it.

Lawyers will often take a case like yours on a no fee basis- a contingency fee. It will depend on how strong they think your case is. If they don't think you have much of a case then they will not take it on a contingency. While no one can predict the outcome of a case before it is tried, having a lawyer decide whether they will take it on contingency will give you a good idea.

I don't know any good employment lawyers or I would recommend one to you.

As far as I know, it doesn't matter where they wish to pick to be as far as what laws are concerned

That might work in a more vague transaction like installing software, or whatever, but when you WORK IN VIRGINIA YOU ARE PROTECTED BY THE LAWS OF VIRGINIA, no matter what paper you sign. Unless they magically were able to have your state taxes paid in Georgia and whatever else.

But, that being said, in Virginia, you are an at-will employee.

Now, they may be doing some legal acrobatics. If you worked from home, or in an office leased by a third party and they somehow classified you as a tele-commuter working in Georgia, that could change things. But if you didn't know that, you still worked in Virginia.

Don't forget, if they are trying to get you under Georgia employment law, and you have a chance of sticking with VA law, you have some options. There might be more favorable rules in GA, or there might be more favorable rules in VA.

Talk to a lawyer. If you have a phone, you have a lawyer.
