It's confusing as why Jason R. Bourcier is not on the sex offenders list, because his conviction under 18.2-67.4 should have landed him on the list, according to the list of offenses listed at
http://sex-offender.vsp.virginia.gov/sor/statutes.html
"Where the victim is... physically helpless or mentally incapacitated as defined in §18.2-67.10"
My thinking is either they changed the law requiring registration after he was convicted, or the fact that Jason Bourcier's victim was drunk does not meet the statutory definition of "physically helpless".
