Panhandlers in the area on the rise??

I used to see a few along route 7 but now I see them in fairlakes area, centreville area.
They do not even look homeless. One was a family of 3 holding a sign.
Anybody notices the same thing?

Did they initiate and make contact with you or was anyone approached and asked for money? Did or does there sign specify money? If not, then specifically, factually, they are not panhandling.
Only to the All Assuming Assumption full of inuendo ALL ASS , OF COURSE,, could you say they are panhandling.

While they may be smelly bums they also know where the money is. Why stand in SE DC and take a risk of being shot when you can migrate to Fairfax where crime is low and the economic demographics are much better.

Not just the bums are panhandling, seems like EVERYONE is panhandling. The Boy Scouts, the Girl Scouts, Bands, Choruses, Cheerleaders (little girls, not the real ones), Veterans, Karate Clubs, Gymnastic Clubs, and then when you go to check out of whatever store you are in, the cashier panhandles you for St. Jude, City of Hope, Childhood Cancer, Children's Miracle Network, Jerry's Kids, and I could go on and on. It just gets very tiresome, and I just want to tell all of them to go pound sand.

There's one at Carlin Springs and Route 50, another at the Harris Teeter on Columbia Pike.

Best answer works of you are walking by with friends, just tell the bum that your buddy has all the money, they are so stupid that they fall for it every time and immediately begin to harass your friend.

Second best answer is "no thanks", like they just offered to perform some service in exchange for the money. It's quick and non confrontational, so you get by without a scene, but leaves them with a vague feeling of being pissed on.

The link you posted is outdated. The current version of the document is http://www.vcsc.virginia.gov/VCCs/2013/AllActiveVCCs.pdf

Secondly, the document is a list of Virginia Crime Codes from the Virginia Criminal Sentencing Commission, which merely specifies how crimes should be punished once the person is convicted of a crime.

ORD-9928-S9 just means that it's a criminal offense if there's a local ordnance against it (the "ORD" part) and that is has a special sentencing structure (the "S9" part).

Panhandling and begging are not crimes defined in the Code of Virginia; they're left up to the local municipalities (cities, towns and counties) to define.

So, you need to find us a specific section from the Fairfax County Code of Ordinances, which is at http://www.municode.com/library/VA/Fairfax_County, which says that panhandling or begging is a crime.

There is a Herndon town ordinance against vehicle solicitation, Sec. 42-136, and it's defined as class 2 misdemeanor (six months in jail, $1,000 fine) in Sec. 42-137. http://www.municode.com/library/VA/Herndon

Article 1. - In General.

It shall be unlawful for any canvasser, peddler, or solicitor to ring the bell, or knock on the door, or otherwise attempt to gain admittance for the purpose of canvassing, peddling or soliciting at any residence, dwelling or apartment at which a sign bearing the words "No Peddlers or Solicitors" or words of similar import indicating that such persons are not wanted on said premises, is painted, affixed or otherwise exposed to public view.

(b)
It shall be unlawful for any canvasser, peddler, or solicitor, to canvass, peddle, or solicit except between the hours of 9:00 A.M. and 8:00 P.M.

(c)
It shall be unlawful for any canvasser, peddler, or solicitor to fail to disclose to the prospective buyer, upon request, his name and the name of the company, product or organization he represents, and if requested so to do, to leave the premises immediately.

(d)
It shall be unlawful for any canvasser, peddler, or solicitor to make any assertion, representation or statement of fact which misrepresents the purpose of his call, or use any plan, scheme, or ruse which misrepresents such purpose.

(e)
It shall be unlawful for any peddler or solicitor to fail to provide, at the request of the purchaser, a written receipt, which receipt shall be signed by the person making the sale and shall set forth a brief description of the goods or services sold, the total purchase price thereof, amount of cash payment, if any, and the balance due and terms of payment.

(f)
It shall be unlawful for any person licensed pursuant to this Chapter to use or exploit the fact of being licensed so as to lead the public to believe that such registration in any manner constitutes an endorsement or approval by this County; provided, however, that the use of the following statement shall not be deemed a prohibited exploitation:"Licensed by the Director of the Fairfax County Department of Consumer Affairs as required by law. Licensing does not imply endorsement by Fairfax County.

(g)
It shall be unlawful for any canvasser, peddler, or solicitor to give false or incorrect information to the Director in filing statements or reports required by this Chapter.

(h)
It shall be unlawful for any person who is licensed as a promoter of an arts and crafts show pursuant to this Chapter to fail to submit a roster of all peddlers, itinerant merchants, or solicitors who are expected to participate in any arts and crafts show being sponsored by that person to the Director no less than three (3) days prior to conducting any such show. That roster also shall indicate the time and place of the expected show.

(i)
It shall be unlawful for any person who is licensed as a promoter of an arts and crafts show pursuant to this Chapter to fail to keep at the site of an arts and crafts show a current roster of all peddlers, itinerant merchants, or solicitors participating in any ongoing arts and crafts show being sponsored by that person, and it shall be unlawful to fail to show such roster upon request to the Director or to any law enforcement official.

(j)
It shall be unlawful for any such promoter to fail to file with the Director a complete roster of all such participants within seven (7) days after the completion of any arts and crafts show sponsored by the promoter within the County. All such rosters shall record the time and location of the event, and such rosters shall identify the full name, address, telephone number and nature of business for each participant. (16-76-31; 43-81-31; 22-84-31; 10-93-31, ยง 1.)

Could be two reasons. One, the economy is shit in which case liberals blame Bush.
Two, Obama has taught people that money is owed to you for the asking. No work required.
In the past people who needed money would offer to do odd jobs or clean up outside a business. Now they are just bums.

I deliberately didn't post an excerpt from the Fairfax Ordinances because there's nothing specifically in there about panhandling or begging. As far as I can tell, Fairfax county hasn't passed any laws about it, probably because they don't want the ACLU or some other civil rights group suing them for restricting some panhandler's First Amendment rights.

That's also why the Herndon ordinance is cloaked in the language of traffic safety. It's specifically to fend off First Amendment claims. That's perfectly fine with me, and it gives the Herndon cops something to do.

You could possibly torture the definition of "solicitor" given in &sectl 31-1-1(a) after you parse the definition of "solicit" into meaning someone who's panhandling or begging, but that's a series of legal gymnastics I'm not flexible enough to perform.

It might be amusing to demand they give me a receipt, as provided in 31-1-1(e).

It is getting damn old. They are everywhere. Not only the usual lazy bums but a non stop parade of non profits to your front door asking for donations. I get at least four every Saturday morning asking for money.

I think the police could get them for fraud or mispresentation under this statute because technically they are solicitors correct? Per the statue the defintion is as follows...

Solicit and solicitation mean to operate from a temporary stand, display or similar facility, or to travel from house to house, door to door, street to street, or from place to place taking or attempting to take orders for sale of goods, wares or merchandise, subscriptions, personal property of any nature whatsoever for future delivery, or for services to be furnished or performed in the future, whether or not responding to appointments prearranged by telephone, telegraph, correspondence or other means of communication. To hire, lease, use or occupy any building or structure, lodging house, apartment, shop or any other place within the County for the sole purpose of exhibiting samples and taking orders for future delivery.

Solicitor means a person who solicits for himself or any other person.


(d)

Saw one today in shopping center at Burke Center Pkwy and Route 123. Lady who looked Indian or something with the traditional dress holding a baby came up to us in the parking lot with a cardboard sign. What is this shit doing in our area all of a sudden? Does a van drop these people off or something? How are they getting here on a Sunday when no bus service? We need to stake them out and see where they go.

Police located the woman and informed her that she would need to cease her panhandling. The woman agreed to comply and left the area, police said.
