Does Fairfax county cops use the Spectre III radar detector detector. I wonder if so how many actually have it.

Seriously, the only reason VA has the ban is to allow cops to collect the $$$.

It seems the other 48 states (I think DC and CT also ban them) get by just fine and they aren't recreating Mad Max or The Road Warrior over there.

It's ALL about the revenue.

Same reason every Va. Police Dept. is always shorthanded and needs more officers on the payroll.

I've never heard of anybody actually being "detected" in FFX County. I've heard of a few that got caught because a cop saw it on their dash or in plain sight.

FYI - Radar detectors use to work great years ago, but that was before laser radar. If you're the only car on the road or not directly in the path of the laser radar then you probably won't get an alert until it's to late.

And, it's not illegal to own a radar detector in VA, it's illegal to have it in an operating position.

This is a myth, Radar deterctors are passive, you can not detect a passive device. Also, VA has banned them as technically VA police is not supposed to hide when doing speed traps. For instance SC you can have a detector, but you will find a cop hiding
in brush that radios ahead to tell the cop behind the wheel to pull you over.

I am afraid I have to correct you Myth Buster...

A RADAR (it's an acronym) detector is a receiver which contains a local oscillator which produces a signal which is combined internally (as in almost all radio receiver) with the received signal.

A RADAR detector detector is essentially a radio receiver and antenna tuned specifically to the local oscillator frequency of common RADAR detector products.

There are ways to attempt to minimize spurious emissions from detectors, and some makers have gone so far as to attempt to use oddball LO frequencies.

As for them being "passive".. some of the old crappy Radio Shack detectors emitted such ratty LO harmonics that they used to set off other driver's detectors.

I have 4 FCC radio licenses so trust me on this one.

Oh and most of the consumer "jammers" are total crap, but if you actually wanted to build one it's not that difficult, but it's an extraordinarily bad and potentially dangerous idea depending on with what you happen to inadvertently interfere.

As for the threads about the laws, I too am pretty sure (having read the Federal regs) that Virginia's law is actually pre-empted by Federal law and that they are illegally enforcing the Commonwealth's law.

I did see what I think is a pretty convenient loophole though, but it would require even more education of the judge than showing him the Federal laws.
(Hint: If your detector ever says "fog", you might be legal within the letter of the Virginia law and chose to litigate a citation.)

I think VA knows they're on shakey ground with the radar detector thing. Why else would they give back your radar detector? I think they're worried that if they take someone's $400 radar detector (without just compensation), they might be looking at a VA Supreme Court case which would overturn the law. Additionally, this is why they don't assign points for detector violations.

They want to keep the penalty small (~$50) to remove any incentive of the defendant to appeal to a higher court and thus possibly set a precedent.

I do not speed.(well, no more than 8 or 9mph above the posted speed limit)

The VA law banning radar detector is clearly unconstitutional. I don't plan
on buying a radar detector, even if it's legal in VA.

However, I do have a $50 Bushnell handheld sport radar.(the kind designed for
sports like tennis and baseball) It's fits in my coat pocket, as well as the
cupholder in my car. It sets off just about every radar detector that I've
come across. Brake lights light up like christmas trees... Enough said...

Keep in mind you can probably get a ticket for that as well, under the same section of the code:

6.2-1079. Radar detectors; demerit points not to be awarded.

A. It shall be unlawful for any person to operate a motor vehicle on the highways of the Commonwealth when such vehicle is equipped with any device or mechanism, passive or active, to detect or purposefully interfere with or diminish the measurement capabilities of any radar, laser, or other device or mechanism employed by law-enforcement personnel to measure the speed of motor vehicles on the highways of the Commonwealth for law-enforcement purposes.

A police officer who sees you pointing a radar gun from within your car might think you are attempting to jam or otherwise 'interfere' with police radar.

Last time I checked, it's perfectly legal to operate a Bushnell sport radar gun
on your own front lawn... to clock how fast your dog is running. how fast your kid
is throwing the baseball... AND how fast the traffic is moving on your street...
(or the Interstate behind the backyard fence)

Well, I sometimes do keep it in my car... the whole thing fits in the cupholder,
like a travel mug, with the speed gun's pistol grip sticking out...

I'm just not sure why it's able to set off alarms in radar detectors on the
highway... don't radar detectors have some kind of filter to know that it's
a sport radar, not a police radar?
