I think VA knows they're on shakey ground with the radar detector thing. Why else would they give back your radar detector? I think they're worried that if they take someone's $400 radar detector (without just compensation), they might be looking at a VA Supreme Court case which would overturn the law. Additionally, this is why they don't assign points for detector violations.
They want to keep the penalty small (~$50) to remove any incentive of the defendant to appeal to a higher court and thus possibly set a precedent.
