Rep. Vito Fossella (R-NY) got busted early Thursday morning for drunk driving with a blood-alcohol level of 0.17 - more than double the legal limit.
He first lied to the arresting officer, saying he was heading to pick up his daughter, 4-year-old Rowan, claiming she was sick and needed hospitalization.
Fossella faces mandatory jail time of 5 days for exceeding the 0.15 blood-alcohol level. It takes about 8 drinks for an average man's blood-alcohol to reach 0.17. At a press conference on Friday, Fossella "refused to say what he drank - or how much - on Wednesday night when he went carousing with constituents after visiting the White House for a ceremony honoring the Giants."
Steve Harrison, a Democrat campaigning to unseat Fossella, said he should "seriously consider leaving Congress." "It's not an 'embarrassment,' it's a crime," Harrison told the Daily News.
While the drunk driving is a serious scandal, another scandal could be brewing. Even though Fossella's chief of staff lives in Alexandria VA, where Fossella was arrested, Fossella was picked up by "mystery woman" Lt. Col. Laura Fay, a.k.a Laura Shoaf, a divorced mother of a young child, who also lives in Alexandria.
Other than lying to the police, Fossella has not said where he really was going that night. Fossella's wife and three children live in Staten Island.
Fossella and Shoaf were in Europe together on July 27, 2003, for a dinner in honor of then-speaker Dennis Hastert. Asked whether their relationship was ever romantic, [Fossella spokeswoman Susan] Del Percio said only, "They're old friends."
When a reporter for the New York Daily News stopped a blonde woman leaving Fay's garage, the woman said only, "I really have to go."
