If that doesn't help and you're forced to take a sobriety test, be sure to ask the officer to repeat himself at least twice every time he asks a question or gives an instruction. If the conversation doesn't go something like this, you're going to fail it...

Officer: Please count backwards from 97 to 83.
You: Do what now?
Officer: Please count backwards from 97 to 83.
You: Count backwards from what?
Officer: 97.
You: To what again?
Officer: 83.
You: And you want me to count?
...
...
...

That's a sure fire way to successfully pass any field sobriety test; by the time the test is complete you'll be stone sober!

Make sure you understand each test completely before starting. Do not admit any guilt.

Delay the test for as long as you can. It may save you a .01 point that could make the difference between .07 legal and .08 drunk.

State of Virginia requires a two party consensus when being audio recorded or video taped without an individual's knowledge. That is why in Virginia when you enter a place of business signs must be visible and clearly state that it is under video surveillance. By entering such places you are giving permission to allow yourself to be monitored on cctv. Maryland doesn't have such laws therefore conversations and incidents may be audio recorded or video taped secretly by individuals not affiliated with law enforcement.

Exactly what I was going to say. Now, that doesn't necessarily matter when you are dealing with cops. Plenty will act like you are breaking the law by recording them. They may even arrest you and confiscate your tape. Plenty of lawsuits about this across the country.


Call a cab idiot. Your night will be much more fun without worrying about getting a DWI. Find a chick to drive you home. Something other than your 1st choice.

B. If you disregard the above and get stopped, don't take ANY tests. I'd be compliant and polite to avoid an ass beating but don't answer questions, don't breathe on the officer, avoid standing and walking. If he arrests you based on some type of probable cause he will have not those tests to use against you. If you get arrested, you're going to get another charge of unreasonable refusal but I'd take that chance.

Slight mis-information.

Key word is "intercept". You videoing a traffic stop is no "interception".

There is what the Supreme Court calls the expected right of privacy. You can not video tape someone peeking over a fence, or with a long lens through a window.

But once you, or the cop, step outside. There is no expected right of privacy so video and take all the pictures you want.

You are correct up to this point.

The officer merely needs probable cause (defined as- a reasonable amount of suspicion, supported by circumstances sufficiently strong to justify a prudent and cautious person's belief that certain facts are probably true) to make an arrest and drag your sorry ass to jail.

This PC is easy to obtain based upon driving behavior witnessed by the officer, the odor of alcohol coming from you body when he talks to you, slurred speech etc.

In order to CONVICT in court the state must prove guilt beyond a reasonable doubt (basically that the proposition being presented by the prosecution must be proven to the extent that there could be no "reasonable doubt" in the mind of a "reasonable person" that the defendant is guilty.)

So, by refusing ALL tests and everything as I talked about before, you make it VERY difficult, not impossible, for the state to prove a DWI case. Consider that may cruisers have cameras and are recording audio. It's very hard to impeach (meaning show that it's inconsistent) that sort of testimony.

Bottom line, please don't drink and drive, it's dangerous.

Read and comprehend "aural or other means of acquisition". This is NOT whipping out your own camera and taking a video. by taking your own video, you are not "acquisitioning" anything.

As long as your not interfering in the police investigation, you are allowed to take pictures videos etc of nearly anything outside.
So videoing a policeman at a traffic stop is ok. Videotaping a policeman when he stopped you, probably not ok.

All this video and recording shit is funny --- lets try reality, ok?

Officer asks you out of your vehicle - you get out and start to record with your phone - the officer asks you to put the phone down and place hands on head / take sobriety test etc... If you do not put the phone down, you can add the additional charges of resisting (or the like), so videotaping is OUT, whether legal or not.

As for not taking the test, that equates to admission of guilt and / or a simple blood test will be done at the station - both prove your DWI. Add to that, by not taking the test, the officer will be more likely to pile on any charges that are available.

A really simple fact is that you can not "beat" the test, but only delay when the police record your BAC.

You are a fucking idiot...when you go to the station, YOU DO NOT HAVE A CHOICE!!! They will, and do, strap you in the chair to get a blood sample. It is not a choice, or something you can refuse...they will physically, and within their rights, force you into the chair. If you struggle, they will use force to STRAP you in the chair --- then take a blood sample.

You CAN refuse the breath test, but CAN NOT refuse the blood test...PERIOD.

This is a FACT - there is no discussion here, or any false information. I will not entertain your ignorance any further...ask a police officer if you do not believe me - they will tell you exactly what I have stated.

NOT IN VIRGINIA. In Virginia you may refuse all tests and have an automatic 1 year suspension. You can not be made to give blood in Virginia, in others states that is true.

However, even with out the tests an officer can still charge you with DUI. It just makes it easier for a lawyer to get you off.

If you refuse to submit to a chemical test in Virginia the officer must inform you of the penalties for test refusal and ask you a second time if you will submit to a chemical test. A first offense refusal will result in your license being revoked for 1-year. You will also not be eligible for a restricted license if you refuse a chemical test.

Any second or third offense test refusal will result in your license being revoked for 3-years and you will not be eligible for a restricted license during the revocation period.
