Section 10: Limits on the States

Clause 1: Contracts Clause

Seems like the Southern states violated absolutely none of these aspects of the Constitution.

Also Note: The South legally attract the United States by firing the first shot at Fort Sumter. The North refused to leave to soil of South Carolina, which was, at that time, a completely independent country.

This is exactly where Chase acknowledges the right of secession. In order to adopt the US Constitution, the states had to secede from the articles of confederation. And so they seceded, thereby setting a legal precedent in favor of secession. It is also why the constitution was not declared to be perpetual. More specifically, it was a huge embarassment to secede from the articles of confederation only seven years after they were "solemnly declared to be pepetual".

Apparently it's beyond your grasp that it is not at all difficult to convey the idea of indissoluble unity more clearly than by the words "to form a more perfect union."

To wit: "to form an indissoluble union" or "to form a perpetual union."

However, the framers of the Constitution dropped the despotic "perpetual" language of the Articles of Confederation -- thus, indeed, forming a more perfect, non-perpetual union.

In particular, it should be noted, first of all, that the right to secession is rooted in the Declaration of Independence, which announced a lawful secession by the colonies from Great Britain based on the right of the people to alter or abolish their form of government.

Second, the union established by the Articles of Confederation, in spite of its exhortation of perpetuity, was terminated by secession.

The proposed Constitution provided that it would take effect upon ratification by nine states. On June 21, 1788, New Hampshire became the ninth state to ratify.

On that date, a new union was formed that seceded from the union formed by the Articles of Confederation -- this secession, however, was in express violation of Article XIII, which barred any alteration in the Articles save by *unanimous* consent.

Third, and most significantly, the exhortation of perpetuity found in the Articles was stricken from the text of the new Constitution.

Nor does the word “secession,” "secede," or any such word appear in the Constitution.

Thus the Constitution in no wise prohibits a state from leaving the union.

Nor does it authorize the federal government to forcibly retain a state that has seceded.

Fourth, when they originally ratified the U.S. Constitution, at least three states – New York, Virginia, and Rhode Island - included clauses asserting the right to secede from the Union at a future time.

Fifth, Federalist #45 states: “The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite.” This principle was in turn enshrined in the 10th Amendment.

Thus Thomas Jefferson in his First Inaugural Address said, "If there be any among us who would wish to dissolve this Union, or to change its republican form, let them stand undisturbed as monuments of the safety with which error of opinion may be tolerated where reason is left to combat it."

Fifteen years later, after the New England Federalists threatened to secede, Jefferson said, "If any state in the Union will declare that it prefers separation ... to a continuance in the union .... I have no hesitation in saying, 'Let us separate.'"

Consequently, the Constitution's silence can in no way be understood as an implied abrogation or nullification of the right of secession, which was firmly established in 1776 (in our secession from Britain, and the grounds articulated in the Declaration of Independence) and 1787 (in the secession from the Articles of Confederation), in the ratifying conventions of at least three states party to the Constitution, and in Jefferson's remarks.

Lincoln's argument to the contrary, discussed in detail in my first post, fails. Chase's argument in Texas v. White - which you repeat no less than five times - merely regurgitates the "more perfect union" portion of Lincoln's argument, and thus similarly fails.

The secession of 1776 was, according to British Constitutional law, quite illegal and accordingly, the founders were all regarded as traitors. The Declaration of Independence was a political document that merely advanced a noetic and and natural law metaphaphysic. Ultimately the right of revolution, as promulgated by the Declaration, had little or no impact on the positive law dynamic. It is therefore the case, that the secession of 1776 was, as I said originally, quite lawless.

Texas Vs White:
Chase wrote that the original Union of the colonies had been made in reaction to some very real problems faced by the colonists. The first result of these circumstances was the creation of the Articles of Confederation which created a PERPETUAL UNION union between these states. The Constitution, when it was implemented, only STRENGTHENED and perfected this perpetual relationship.[14]
The Union of the States never was a purely artificial and arbitrary relation. It began among the Colonies, and grew out of common origin, mutual sympathies, kindred principles, similar interests, and geographical relations. It was confirmed and strengthened by the necessities of war, and received definite form and character and sanction from the Articles of Confederation. By these, the Union was solemnly declared to "BE PERPETUAL." And when these Articles were found to be inadequate to the exigencies of the country, the Constitution was ordained "TO FORM A MORE PERFECT UNION." IT IS DIFFICULT TO CONVEY THE IDEA OF INDISSOLUBLE UNITY MORE CLEARLY THAN BY THESE WORDS!!!!!. What can be indissoluble if a perpetual Union, made more perfect, is not?[15]

Okay, so here's the deal. Admittedly, I have been jerking Gordo around, in part because it is positively hilarious to see how foaming-at-the-mouth hysterical he becomes. But on a more serious note, I have repeatedly challenged him to find a prohibition against secession in the Constitution(there is none). Gordo has, quite predictably, and as only that semi-literate miscreant could, frantically relied on Texas v White and, and hilariously, the PREAMBLE. Here's where it gets really fun; the preamble is merely a declaration and has no power. Here is the language of the Supreme Court, Justice Harlan for the majority:

"...The United States does not derive any of its substantive powers from the Preamble of the Constitution. It cannot exert any power to secure the declared objects of the Constitution unless, apart from the Preamble such power be found in, or can properly be implied from, some express delegation in the instrument..."

Gordo is such an ignorant boob, that it almost cruel to toy with him this way. But he is also a complete asswipe, so what the hell, I humiliated him and I enjoyed it. Hehehe....
