A federal judge found probable cause that a Charleston man participated in the Jan. 6, 2021, assault on the U.S. Capitol, pointing to photographs of him wielding weapons near the front steps as well as an electronic device tracked to that same area.

A March 26 preliminary hearing was held in U.S. District Court in Charleston for Justin Daniel Perrou, 44. The next step is for a grand jury in Washington, D.C., where Perrou's case will be transferred, to determine if there is enough evidence to return an indictment against him.

The criminal cases stemming from the Jan. 6 attack are all being prosecuted in Washington, D.C.

At the hearing, Matthew Tulla, a member of the task force investigating the Capitol assault, testified that about a dozen still images taken from open-source video footage show Perrou near the front of the mob that stormed the Capitol.

Two clear images show a man with grey scruff — like Perrou still sports today — wearing a green mask pulled down to his neck, glasses, a black cap, grey hoodie and dark-colored winter jacket in the mob.

The FBI has identified Perrou in multiple other images taken from further away. Assistant U.S. Attorney Christopher Lietzow said the images show Perrou entering a restricted area outside the Capitol sectioned off by boundaries the mob broke through.
