Since Nixon all documents produced by or given to a sitting president while he is in the White House are the property of the U.S. Government. The president cannot unilaterally alter that rule. It requires an act of Congress. Even if the president removed the documents lawfully, as other presidents have in the past, he is still legally obligated to turn them back over to the U.S. Government upon request. That request does not have to specifically state what each document is. It can simply be "Give us back the documents you took". Donald Trump was served with a subpoena to turn over the documents he took. Regardless of whether he removed the documents to Mar A Lago legally or not, Trump was under an obligation to return them.
Technically what Donald Trump did constitutes a crime. He was unlawfully holding on to government property. The standard for the FBI to step in and seize the documents has clearly been met.
Whether the documents were classified or not does not matter. The Federal government is entitled to have its documents returned to it whether the documents were classified, formerly classified, merely embarrassing or entirely innocuous.

Then team Trump produced an email from the DOJ that confirmed they had seized his passports and they were returning them.
