with prison you have to do something other than "#covid claim can't go to work because of covid". you can't let robber-killers out but you if you can't keep prison open during "biden shutdowns"?
these days a death penalty ruling usually goes on for decade after decade (huge taxpayer waste of money)
the move to open the death penalty in 1 state is likely a move for certain law makers to get paid. i doubt you will see a ruling and following executions.
