Former Fox News anchor Andrea Tantaros has filed a second lawsuit against the network, claiming that former CEO Roger Ailes, current co-president Bill Shine, and other top executives spied on private communications and authorized the creation of fake online social media accounts to intimidate her after she complained that Ailes had sexually harassed her.

In the lawsuit, Tantaros likens the surveillance activities to a plot from Homeland’s “Sock Puppets” episode and claims that it began in retaliation of her initial sexual harassment suit against the network, which is currently in arbitration. She also asserted that “these digital weapons are being used against the victims of sexual harassment” and “continued unabated” through April 2017.

The claims are staggering, though not without precedent for those who have been critical of the network and its former CEO Roger Ailes. Tantaros alleges that after she first complained about Ailes’s alleged sexual harassment in 2015, Fox News created “sockpuppet” Twitter accounts—fake accounts created by third party companies to manipulate online conversations—to “cryptically let her know that she was under surveillance.” She also claims that some of the accounts used private information obtained by a Fox News operative, who had installed key-logging “and other surveillance software” on her personal computer.

Examples of this include receiving a tweet in June 2016 for an ad for the DVD of 1957 film The Black Scorpion after one of her friends was hospitalized due to a scorpion bite. That same month, one day after she and her mother had spoken about the death of her brother Daniel on the phone, she received a tweet about Daniel’s death. Daniel died in August 2013, the lawsuit notes, claiming the timing of the tweet “was designed” to upset Tantaros and make her paranoid. In July, after a friend in the military told her his unit was adopting a dog named “Egypt,” she received a tweet with a picture of a tour company named “Egypt Tours and Travel.”

She also claims that some of the tweets were deleted days before she filed her complaint in April 2017:


Judd Burstein, Tantaros’ lawyer, called it “cyberstalking on steroids.” He told NPR that Fox News “harassed her through sock-puppet social media accounts which conveyed the illegal fruits of their electronic surveillance of her. It was in essence two crimes committed at the same time.”

As they did with her last lawsuit, Fox News released a statement saying executives “flatly deny” the claims, calling them a “flimsy pretext to keep Ms. Tantaros and her sexual harassment claims in the public eye after the State Supreme Court directed her to bring them in arbitration.”

Former Fox News host accuses network of illegal electronic surveillance


Former Fox News host Andrea Tantaros, having already sued the network for sexual harassment, is now accusing it of orchestrating a "criminal scheme" involving what she claims were illegal electronic surveillance and online harassment of her.

In a complaint filed Monday in a Manhattan federal court, Tantaros said that her ex-bosses at Fox monitored her emails and listened to phone calls, and then conveyed "that they were doing so through cruel social media posts."

The complaint asserts that a forensic examination showed that anomalies on Tantaros' laptop "are not malware or known viruses that could have been found or transmitted through 'general surfing' of the Internet."

Moreover, the complaint alleges that the surveillance continued both after Tantaros left the network last year and after former Fox News chairman Roger Ailes was ousted amid sexual harassment allegations last summer.

In a statement from their outside counsel, Dechert, Fox News and its executives said they "flatly deny that they conducted any electronic surveillance of Ms. Tantaros."

"They have no knowledge of the anonymous or pseudonymous tweets described in her complaint," the statement said. "This lawsuit is a flimsy pretext to keep Ms. Tantaros and her sexual harassment claims in the public eye after the State Supreme Court directed her to bring them in arbitration."

Susan Estrich, an attorney for Ailes, said the lawsuit "is without merit."
"Ms. Tantaros and her attorney continue to file one lawsuit after another in an obvious attempt to get publicity. This suit has no merit. And any suit arising out of her employment at Fox News belongs in arbitration, as they well know," Estrich said in a statement. "The courts and the parties should not be burdened by repeated filings such as this."

A former co-host on a pair of Fox News talk shows, "The Five" and "Outnumbered," Tantaros sued the network last August, claiming she was sexually harassed by Ailes and that she was punished after reporting the abuse.

That lawsuit, which was filed a month after Ailes resigned in disgrace, also alleged that Tantaros was the subject of unwanted advances from Bill O'Reilly, the popular host who was let go by Fox News last week following revelations of settlements paid to women who accused him of inappropriate behavior.

Judd Burstein, Tantaros' attorney, said his client was surveilled because "she was an existential threat to them."

"She's the only person who alleged that the problem was not just Roger Ailes or Bill O'Reilly, that it was an endemic problem," Burstein told CNNMoney.

The new complaint says that its claims are "fundamentally different" than those detailed in the lawsuit filed last year, which has moved into arbitration.

Last August, former Fox News anchor Andrea Tantaros filed suit against her erstwhile employer, memorably alleging that despite Fox News' promotion of traditional family values on air, "behind the scenes, it operates like a sex-fueled, Playboy Mansion-like cult, steeped in intimidation, indecency, and misogyny." That suit is in arbitration, but on Monday, Tantaros reached into popular culture again to allege in a new federal lawsuit that after she accused since-ousted Fox News chief Roger Ailes of sexually harassing her in 2015, the network hacked her personal laptop and cyberstalked her using "sock-puppet" social media accounts, like on an episode of Homeland.

Fox News sent operatives to install surveillance software on her computer, monitored her phone conversations, and then used the private information it gleaned about her to "intimidate, terrorize, and crush her career through an endless stream of lewd, offensive, and career-damaging social media posts, blog entries, and commentary," according to Tarantos' lawsuit. Her lawyer, Judd Burstein, said it amounted to "cyberstalking on steroids," with the network having "harassed her through sock-puppet social media accounts which conveyed the illegal fruits of their electronic surveillance of her. Fox News, through its lawyers, said the network and its executives "flatly deny that they conducted any electronic surveillance of Ms. Tantaros" and "have no knowledge of the anonymous or pseudonymous tweets described in her complaint." Former Fox News host Andrea Tantaros has reportedly filed a new lawsuit against her former employer and its former CEO, Roger Ailes. The lawsuit alleges that the network harassed her by sending her threats and "creepy messages," on social media, writes the New York Daily News. Moreover, Tantaros claims in the suit that Fox tapped into her personal devices to spy on her.

FOX News outside Counsel Dechert, LLP provided Fast Company with the following statement:

"Fox News and its executives flatly deny that they conducted any electronic surveillance of Ms. Tantaros. They have no knowledge of the anonymous or pseudonymous tweets described in her complaint.
