Depends on the circumstances and what court, and in what country, is deciding it. There was a similar case with Brazil - Sean Goldman I think was the little boy. The father is American and the mother Brazilian. Sean is an American citizen though because he was born here and the mother basically left the husband and returned to Brazil with the child, remarried and then subsequently died. Her Brazilian husband bascially acts as an adopted father and refuses to give the child over to his American family.

Were the children born here or in Japan? And is the mother an American citizen?

If the kids are legal US citizens from a legal US citizen father and Japanese national mother, I'd say the father should get the kids, unless he's been deemed unfit to have custody. I would think it'd be easier on the kids that way.

However, people rarely consider what's best for their kids, and do what's best for themselves.

Easier said than done.

International law plays a major role. In each of these cases, neither country has a parent-abduction agreement with the US. The country where the children resides holds all the aces.

Court ruled child custody arrangements are like restraining orders - they are intended to protect all parties involved but don't take effect until the worst happens - and then it's usually too late.
