Court will not stay or limit the TRO -this is going to the SC. Though they didnt like the Washington Solicitor's opening position its clear, to me, that the Executive Order is so defective, so general and non-specific that by its very nature, not on the merits but on structure so as to be unable to be enforced in a manner that will not present a multitude of more lawsuits and injustices.

I believe the white house used its considerable power in a manner careless enough in execution so as to force the courts to deny it.

These judges should be fired for meddling in national security which is not their job and for good reason.

Part of being a government of laws means not only getting the right result but getting it through the right process. Bush was properly abused for ignoring laws passed by Congress that he did not agree with. Obama was properly abused for trying to implement immigration policies by executive order that should have first been authorized by Congress and for failing to support the DOMA in court.

I am not betting on whether Trump's current immigration orders are legal as is. That is going to require a better understanding of immigration and travel laws than I or most that post here possess. It's also possible the court might twist the legal interpretation of the order sufficiently that they can uphold the order while limiting its effect. I was surprised that Trump's initial order as reported in the press did not contain an express exemption for all individuals who were current legal residents of the U.S. Being a legal U.S. resident does carry with it certain rights, including the right to continue to reside in the U.S., which cannot be taken away simply by issuing an executive order. That is the kind of thing any DOJ lawyer fresh out of college could have told the administration.

I realize some Trump voters want him to implement the policy even if it means disregarding the rules. The danger to this is that if you ignore or change the rules to help you when you are in power, it can come back and bite you when the voters change their minds and vote the other side into power. The revolution of 2016 will likely be no more permanent than the revolution of 1980 or of 1960/64.
