It's not even really a "loophole." Trump and anyone else who runs a business which rolls up to them personally, like most single proprietor LLCs and similar small businesses, pay taxes on their business as that individual. To the extent that they have profits, they pay. To the extent that they have losses, they don't pay. For tax purposes, you can only recognize losses to the extent that you have income to charge them against and depending on the type of loss you can only charge so much in a given year. So, you're permitted to carry any excess in a given year over to future years. Same for capital gains/losses from stock and charitable contributions over the limit. It's a generally fair way to do it and basically just puts you at net zero for taxes vs somehow making any money or avoiding any taxes. Relatively simple concept for anyone who runs a business or has investments. Now there might be some "loopholes" and accounting tricks in how you get to profit or loss at a lower level from that but the tax treatment itself is not a "loophole." You don't gain or avoid anything, you're just spreading it over time.

I do taxes all the time.
