Friend got a DUI on his wheel chair

My friend said he was out in Utah a couple of months ago and going back to the hotel and ended up with a DUI while driving on his wheelchair. He had a .12 when he was stopped. Do you think his is true?

Assuming this was after he failed the basic sobriety test where you have to be able to...stand and walk?
