Why are switchblade knives illegal to conseal and carry in Virginia.

A buddy of mine got a drunk or profane charge and was arrested in a bar. The cops found a switchblade in his pocket so now he has a weapons charge as well. Seems like bullshit. The magistrate said they would not have pursued the weapons charge had he not been intoxicated at the time.

Concealed Carry

Virginia Code section 18.2-308 prohibits the concealed carry of “any dirk, bowie knife, switchblade knife, ballistic knife, machete, razor, slingshot, spring stick, metal knucks, or blackjack.”

What the fuck is a dirk?

In Virginia you can legally own an "assisted opening" knife which is almost identical to an automatic knife. There is a slight resistance when you push open the knife and then it springs open.

Also illegal, those knives that are spring loaded and shoot out as a projectile. Russian special forces use those.

They are made to kill a person (much like handguns),close quarteer combat.
Assisted opening knives and 'gravity blades" are fast but not as fast as an automatic knife. They were, maybe still are< issued to pilots and flight crew for quick escape from parachute. Military and cops are allowed to carry them.

I'm just getting started in blade collecting. My dad left me a few knives
many years ago and I never paid much attention until lately. Turns out the
five of them are worth about $1,200.00 retail. I also have a bayonet that was issued in Vietnam that's worth a few bucks. Interesting new hobby. My wife
will have to get a part time job to pay for all this.

Good to know - I may forget my wallet but I never forget my Kershaw. Good knives.

Question: what constitutes 'concealed' carry? If I clip my knife on the top of my pocket (and the end pokes out a bit), is that enough to avoid trouble?

Generally considered to be 'not in plain view'. For instance, if you wear your dirk on your hip in a sheath that would not be considered concealed. Same logic applies to a gun in a holster.

Since your knife is only assisted opening you don't need to worry about how you carry it.

If you had a switc-hblade that clipped to the top of your pocket so that what it was is obscured, I gather that would qualify as concealed. But I suspect this is a legal gray (or grey of you prefer) area that would require clarification from the Virginia Supreme Court.

Only in the sense that you are considered to be selling said items which is illegal.

"The having in one's possession of any such weapon shall be prima facie evidence, except in the case of a conservator of the peace, of his intent to sell, barter, give or furnish the same."

You would need to go to court and prove you were not selling said items.
