WILMINGTON, Del. -- A judge who sentenced a wealthy du Pont heir to probation for raping his 3-year-old daughter noted in her order that he "will not fare well" in prison and needed treatment instead of time behind bars, court records show.

Superior Court Judge Jan Jurden's sentencing order for Robert H. Richards IV suggested that she considered unique circumstances when deciding his punishment for fourth-degree rape. Her observation that prison life would adversely affect Richards was a rare and puzzling rationale, several criminal justice authorities in Delaware said. Some also said her view that treatment was a better idea than prison is a justification typically used when sentencing drug addicts, not child rapists.....


Richards, who is unemployed and supported by a trust fund, owns a 5,800-square-foot mansion in Greenville, Del., he bought for $1.8 million in 2005. He also lists a home in the exclusive North Shores neighborhood near Rehoboth Beach, according to the state's sex abuse registry. His great-grandfather is du Pont family patriarch Irenee du Pont, and his father is Robert H. Richards III, a retired partner in the Richards Layton & Finger law firm.

Despicable? Yes. Should not be let off like this, of course he should not be let off just because it's "only" a finger and not his penis. But why do most American media think they should hide such details? Speaking as someone who was abused, there is a difference, there are different levels of "monster" behavior, and it does not make us soft on crime to state that, it makes us more accurate. In fact they may harm kids if all people ever read about is the word "rape" then if they see something in their own lives, they might choose not to report it thinking "those stories of scarred kids were about rape with penis" not realizing the kids get scarred this way too...so while staying within the law, they should report details like the Australian paper did (news.com.au)

Of course this makes the law firm's name " Richards Layton & Finger" the most disgusting and revolting coincidence I can think of...yes you can find the quote by online search, in the previous post

To be clear, I am not criticizing the word "rape" being used, it is often the legal definition (so long as they use it also when a female uses her fingers to penetrate someone, so there is no double standard) But the criticism is not the use of the word "rape" but the lack of specifics to state as the Australian paper did, that the (still horrible, criminal, sick, etc) penetration was with his fingers (yes fingers, see quote above, this sick used more than one)

There are weird charges like "crimes against nature", "sodomy" and "inanimate object penetration"..

I wouldn't split hairs over the definitions mate, it would be fine with me if he was convicted of "being father of the year" as long as he received sufficient lockup time.

That's what I'm saying: it's ok with me to call it "rape" when it's with a finger..but do not patronize the public by hiding whether it was a penis or a finger or an object...my original post at 08:07PM even suggests why it might be harming kids (the opposite effect) by withholding information.

Agree on "sufficient lockup time" and I think life-long monitoring is what I would add to that for anyone like him, if or when they do get out of prison..and for somone that rich, for him to pay the full cost of his own (and maybe for a few others) life long monitoring after he leaves prison..

Considering my white upper middle class status, I don't think prison is the appropriate environment for me either.

Didn't one of those DuPont guys get blown away with a shotgun a long time ago by a kid he was sexually abusing on a wrestling team he sponsored or coached?

Not speaking specifically about what this guy did.

Just a question about enforcing laws selectively-

Say, for example, there was a real good guy...did a bunch of charity work, made a bunch of money (and therefore paid a bunch in tax money), coached teams, and was generally a pretty good guy...and then did something stupid, like maybe got in a drunk driving crash.

Then, say there was a real bad guy...never did sh**, maybe was on welfare, never really worked (therefore, not only did he not pay taxes, but took tax-sponsored benefits), never really contributed to society, and was generally an ass****, but managed to stay out of trouble with the law (in other words, never got caught)...until he did something stupid, like maybe got in a drunk driving crash.

Same penalty for both?

If so, why?

What would you say, if for example, the crime was one that is oft times considered victimless, like have a few oxy w/o script?

Prosecutors, lawyers and judges will take it into consideration the stability of the defendant, community ties etc. when evaluating the potential for recidivism. The natural inclination is that the more stable, the less likely for a future fuck up.

Not really equal justice, but that's the school of thought.

The judge didn't consider this. The judge considered what would happen to wealthy white child molester in prison. Sandusky went to prison. Why? He is white. Oh yeah, he doesn't have any money.

And, why not give somebody credit for being a good person before the "crime"?

Wouldn't that motivate people to be good people?

And, why not reward people who are good to society, generally, as opposed to those are bad to society?

Some financial criminal cases will get lesser sentences as the judge figures if there is restitution to be paid to victims, it's better off to have the defendant free and working for $100k a year and paying back than sitting in county jail. This kind of bothers me but if the victims agree to it with the prosecutor/judge I can't argue.

I can't see giving any kind of break to this tot-tapper. If someone took it onto themselves to kill this punk, I would definitely turn the other cheek.
