After one year as the law of the land, mayhem abounds.

Where we stand one year later.

This thing, unfortunately for Obama, is like watching the Hindenburg crash.It is already on fire and on steady descent. By year 2015, the year it was suppose to be in full effect, it will be but a footnote in history.

• More than half the states—28 and counting—are challenging the law in court

• Health and Human Services Secretary Kathleen Sebelius has handed out nearly 1,000 waivers to allow select companies, unions and states to escape, at least temporarily, some of the burdensome new insurance rules she has created.

• Independent experts have shown that the cost of health insurance will rise faster than it would have without the law.

• Seniors are at risk of losing access to physicians and medical care. Medicare actuaries say that the cuts built into the law will force as many as 40% of providers to eventually stop seeing Medicare patients or go bankrupt.

• Many thousands of people are already losing the health insurance they have now as companies are exiting markets for individual, small group and Medicare Advantage coverage.

• The former director of the Congressional Budget Office, Douglas Holtz-Eakin, says that the costs of ObamaCare are set to explode when employers opt to drop coverage and send their workers to the new, federally subsidized health exchanges for coverage. He estimates that this will drive up the cost of the law by $1 trillion or more in the first 10 years.

The higher the price of gas goes, the farther down his chances of re-election go. If gas keeps rising like it has, Obama will be viewed even more so as another Jimmy Carter. Perception is reality in the minds of the public and once he has that label, he is done.

During the health care battle, Republicans banked heavily on the fact that those who aspired to get health insurance would not be as well organized or as vocal as those who feared that the law might cause them to lose the health coverage they already had. Their entire strategy was based on building fear among the vast majority who had insurance or Medicare. That is one of the reasons why it was so difficult to pass health care reform. It's also why -- even though Democrats won the battle to pass the bill -- we, temporarily at least, lost the war for public opinion.

Had a public option -- or Medicare buy-in for those under 65 -- been part of the measure, a large number of people would have been vested with benefits much sooner than the 2014 effective date, when most of the other benefits take effect. It simply would not have taken four years to construct a system that allowed people below 65 to buy in to Medicare, which of course is an on-going concern. That would have increased levels of public support for the law much more rapidly, and is one of the reasons Republicans fought these provisions so doggedly.

Both sides always think they know what's going to happen because they, or their hirelings are so smart. But they don't. They're all guessing.

Both sides think they'll win because they truly believe they are right. But that's irrelevant because, usually, they're both just rationalizing greed.

Finally, and perhaps worst, both sides think that they can foresee the worst-case scenario that may afflict the public if they are somehow wrong. "Manageable," they say. But they're wrong. History doesn't play fair. Bad decisions create their own chain reactions.
