Moving out of state while on probation
Posted by: pre ()

I have been sentenced to a year probation for a minor criminal charge. At first I was on supervised probation but after about 6 months my PO put me on unsupervised. I haven't had any issues with the law since nor am I planning on it. My job however offered me a position that would require to relocate to another state. I have been trying to reach my po for the last week without any luck and have to give my boss an answer in a few days. Any of you with first hand experience have any insight on the matter?

Define "minor". "Don't move out of state" is almost always a condition of probation for charges that are a felony. Misdemeanors don't usually (but can) carry that condition. This should have been made clear at the sentencing hearing.

Even if it is a condition, you can probably get the court to allow it for cause if you have kept yourself out of trouble, depending again on what you were charged with.

But this has to be done through the PO and the Court System.

Unilaterlly doing it on your own is a recipe for trouble.

Got stopped with a friend that had small amount of pot on him. I was charged with a possession misdemeanor. All I got was a year supervised probation as I have never been in trouble before, not even a moving violation. My PO quickly realized that I am not out causing trouble and put me on unsupervised. I remember one of the conditions of SUPERVISED was that I was not allowed to move to another state and I had to notify my po if I traveled outside of the area. Whenever I did travel outside of VA I would just email him and that was enough. I got a new list of conditions for unsupervised probation which only mentions that I should notify him of any police contact and if I change address. Nothing about relocation to another state or traveling.

Save yourself a world of trouble and get something from your PO in writing (if you can) saying you can leave the state. The last thing you want to do is cock things up by letting a misunderstanding happen that results in an outstanding warrant or something.

My parents had some probation guys (unknown at the time of employment) come and cut down some trees. They had no shirts on and were wearing only cargo shorts. They had a limb cutter and a chainsaw. No ropes or anything. The one guy proceeds to saw the tree with a chainsaw for about 20 minutes and then they just left. They left their equipment too. Two hours later they came back, and threw a brick at the window but it didn't break (thick glass). Then my mom called the cops and found out they were wanted and they were high on meth. What a life.

your mom freaked them out by deliberately staring at them through the window.

you don't do that to guys on meth.

can't blame them for leaving, or coming and back and throwing a brick at her, either.

The charge doesn't show up on my record. It was part of the plea for me to complete the probation and then it will be dropped. I am not really trying to get over my POs head, just trying to get by without causing any further problems for myself. I still haven't heard back from him. Even when I was on supervised he didn't really care if I left the state to travel as long as I let him know, usually in a form of an email. I don't see my moving being part of the probation rules but I just want to make sure.
