$50 ticket for "For Sale" sign on my car

Car was parked outside my house on an off the beaten path street. Ticket cites code 82-5-19 "Parked with For Sale Sign - Prohibited Purpose". The law is real. I am going to pay this ticket. Just feel bad for the old folks who sell cars like this and don't use CL/Autotrader. I don't know if I want to take a day off work and schedule a time to speak to the FFX cty board. Never even done it before. Ticket was a shock so I thought I'd get the word out in case you ever want to sell a car using traditional methods.

You don't need to take a day off from work to tak to the Fairfax City Board, loser. Nice try with your sympathy fishing pole though... If you want to talk to the board, write them a letter, email, fax, send the letter via bike messenger or drop it off yourself.

You feel bad for the old folks who don't use CL or Autotrader? Does this mean we should feel bad for you since you also chose NOT to use these services?

This is 2012. Selling a car by traditional methods? Um yeah...that means using CL/Autotrader now. NON-traditional is currently the "For Sale" sign...ticket or not.

Next time? Just leave it at, "Hey, I got a ticket for trying to sell a vehicle with a For Sale sign on the street in front of my house. The code is 82-5-19. That is kinda lame. I guess I can see why they wouldn't want cars parked all over for sale, but a simple sign as you describe it doesn't seem like the intended purpose of the law. In any case, I wasn't aware either.

Some shitbag parked his broken down Altima behind my car on the street one time, with the rear of the car all out in the street, and then stuck a for sale sign in the windshield. I called that bitch with the number on the sign and told him if it wasnt moved in two hours, I would call the police. 10 minutes later a car-full of hispanics showed up and tried jumping it, and when that failed, they put it in neutral and pushed it down the street. I was LOLing from my window the whole time.

Grassy is right. It must be on a paved surface. We a ticket for having one parked in the grass next to the driveway. The county is really hurting for money. In June they went around Pimmit Hills and at least two other neighborhoods and found many obscure things to ticket for at $50.00 a pop. That should have helped the fiscal year figures since the tickets are due in 21 days. The part I got the biggest kick out of was that you using the envelope that was put with the thicke the payemnt is mailed to Maryland

They also changed the "commercial" vehicle law July a year ago. No more enclosed trailers or vehicles over 21 feet long unless it's an rv or a boat. I got a $125 parking ticket for parking my enclosed trailer in front of my house.

i dont think you were just parking it in front of your house. also, seems you didnt check it on a daily basis as you would have seen the warning.

if these are not the case then there is something wrong with the situation and someone's got some splaining to do.

They don't always do that. I had one towed while disabled with no warning. Somebody hit it in front of my house and I had to leave it there for the insurance inspector. After I bitched, they did let it go without charging the tow and impound fees but still was a pain in the ass.

Yeah unfortunately, they didn't give me a warning. It was indeed parked in front of the house except when I'm at work (I use the car daily). Car had/has valid registration/plates, state and emissions inspections and insurance too. I had the signs on it for about a month and a half before I got the ticket too. I think the guy just spotted it while he was driving by. Lucky me I guess lol.

After weighing the option of potentially spending hours of time and court costs versus just paying $50 for it, I have contested it. After navigating through the circular phone menu for 4-5 minutes and a 15-20 minute wait time (they called me back), the operator tried hard to get me not to contest it. She mentioned I would be paying an additional $75-$100 in court costs and if I was sure I wanted to do that. They will now mail me an affidavit which I have to fill out and mail back to them within 10 days. When she took down my address, she did not get the whole thing before stating that I'd get the affidavit within 10 days. I hope it arrives in the mail. She asked why I was contesting it to which I replied that the code says they should give a warning ticket. She replied, "You don't get warnings for parking tickets". I just said I'm going by what the code said (thank you Gravis). In a really reluctant tone she said "Well ok, I'll note that on here".

Here is my guess: The system is definitely contracted out, they called me back from a number in Wisconsin. They must be paid on how many potential disputes they turn away or the opposite, they get paid a certain contract amount and the costs for scheduling the dispute, they pay for.

In other jurisdictions, they have dropped the tickets for different reasons. Some people have argued that it's a violation of their first amendment right to free speech, others have argued provisions in their law in their specific jurisdiction. In some places, if it is parked outside your house then a ticket/tow does not stand "for the original intent of the law". I didn't see anything about that in our code but I will continue to research.

Maybe you should read the code you are cited under. It does not require a 48 hour warning to give you a ticket. Read the whole code for what somebody else claims is a 48hr warning. Also you were cited under the county code and not the state code. The state code has no affect on the county code. But hey...good luck in court.

The county code says the following:

(a) It shall be unlawful for any person:
(1) To park or place any automobile, truck, trailer or other vehicle upon or in any street, alley or parkway for the purpose of selling or offering the same for sale or rent;
(2) To attach or place any sign or lettering upon any automobile, truck, trailer or other vehicle parked in or upon any public street, alley or parkway indicating that such vehicle is offered for sale or for rent;
(3) To park any vehicle from which any merchandise is being sold upon any street in a business district;
(4) To stop a vehicle at any time upon the highway for the purpose of advertising any article of any kind, or to display thereupon advertisements of any article or advertisement for the sale of the vehicle itself. (3-13-69; 1961 Code, § 16-123.)

You are correct, there is no mention of a 48 hour warning in the county code.

The best argument would be on 1st Amendment grounds. The County got sued by that church in Oakton under 1st amendment for having an 'illegal' sign. They county rolled over quick on that one. See if you can get a copy of their legal brief and just rehash their arguments.

The court will probably claim that commercial speech is not protected as much, but it might be more exciting than just writing the check first.
