Actually, a real bounty hunter had better be 100% certain that he's got the right person when detaining someone. It's true that Virginia has some very loose laws when it comes to bail bondsmen and bounty hunters.
However, if a bounty hunter were stupid enough to grab the wrong person then they could very likely be charged with kidnapping and various other crimes.
Yes, a bounty hunter can break into a house, can go just about anywhere to arrest the bail jumper and he has a lot of leeway in the methodology of his work. Nevertheless, the line that must not be crossed is detaining an innocent person by mistake or otherwise. That is a protection that bounty hunters do not have.
