Welcome to Fairfax Underground, a project site designed to improve communication among residents of Fairfax County, VA. Feel free to post anything Northern Virginia residents would find interesting.
I got a speeding ticket on Rt. 28 - it's 100% my fault, I was going 20 over. I was nice to the cop and the cop was nice to me - he wrote me up for speeding, NOT reckless.
This is my first ticket and I've had my license for 11 years.
I'm going to go to court - not because I want to fight it, but because it's my right. When I'm there, I want to ask the judge to reduce/remove the points on my license.
My question is, can the judge reduce/remove points? I've read/heard conflicting things.
No, DMV is who gives points. The courts/judges have no control over the amount of points you get. You can go to a driving class and after you finish, take your certificate to DMV and they will give to five "plus" (good) points.
if it's speeding and he wrote the speed as 20+ then it's a six pointer, four if it's less speed
I have seen judges reduce the amount of speed or reduce the charge to failure to obey and exotic things like that, that will in turn reduce points yielded upon conviction, I have not seen it more than 2 or three times though. I think it was always some kind of thing where pretty much everyone got off that day on the minor stuff. I once heard a judge tell the court he was going to go light on the "minor offenders" that day so he could "focus his energy" on the stack of more serious offenses he had on the docket.
I just went to fairfax traffic court and the judge was hookn everyone up, He was droppn must of the tickets and if you said it would be hard to pay that much he was droping it down to like nothing, It was cool of him

A "nice cop" would have written the ticket for 19 over. I had one do that once, when I was 20 over. Expect your insurance rates to go through the roof because of one stupid MPH.
Points will be the same. If you have a clean record(+5 points) then let the judge know that. He may reduce the fine, but he can't help you on points. Take the safe driver course like highlander said. That could help you with insurance also. The judges give you a break at court because you took the time out of your day to admit your guilt.
Yo so I was pulled over and cops found a crumb of weed on me. You think I'm gonna get anal raped when I go to jail. Let me know I wanna make sure my butthole is stretched... don't wanna tear a glute.

His insurance rates should be back to normal now, given that the thread was started in 2005.
