What does Nolle Prosequi mean? Does Commonwealth retry nolle prosequi cases?

A case is normally "nolle prossed" (slang) so that the offense at hand can be re-charged at a later date if needed/necessary.

Normally you would want a case to be dismissed so that it couldn't be charged again for the same offense.

nolle prosequi is almost never brought up again. it isn't dismissed but in order for someone to go after you once they decided not to means you deserved what is coming to you.

nolle prosequi means that the prosecutor or plaintiff decided not to pursue
charges against a defendant for whatever reason. The prosecutor "dropped" the
charges.

although very very very rare, fuzzymonkey is correct, the defendant can be
re-prossecuted for the same charges again in the future.

Usually this is true but in Fairfax County the chief prosecutors Robert Horan and Ian Rodway have a tactic of nolle prosequi'ing a case in General District court only to immediately obtain an indictment in Circuit Court and bring it all back.

They do this so they can skip the General District court "pre-trial" date and prevent the defense from receiving valuable information before the trial.

Really shady tactic. I wonder if any other jurisdictions in Virginia are known to do this or if it's just Fairfax.

I also think they like the fact that Fairfax's circuit court information isn't available online, which makes NO sense considering that nearly every other county in Virginia provides an online database.
