Richmond at it again... $2500 for running a red light!

Looks like Richmond wants more money and has figured out a great way to do it without raising taxes... House Bill 1993 will make all red light violations to be reckless driving, not infractions. This means tickets for running a red light can have fines of $2500 and up to a year in jail...

Better come to a complete stop at any stop sign or red light. I wonder how this will affect red light camera tickets?

Also, before you say "This is only for violations resulting in injuries", notice that the House Courts of Justice Committee amended the bill to refer to any violation... that's the version of the bill as it stands now.

Don't trip so fast. It's the same shit that Dave Albo was given so much crap for...

The key words are "up to". Not a mandatory fine and the judge has the leeway to fine you lots and lots less. The top number is for really aggregious violations.

The media does this all the time when they have celebrity criminal cases- they state the statutory max and lead you to believe that Lindsay Lohan is going to goto prison for 16 years for whatever her latest transgression was.

Move along, nothing to see here.

AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee for Courts of Justice
on January 31, 2011)
(Patron Prior to Substitute--Delegate Janis)
A BILL to amend the Code of Virginia by adding a section numbered 46.2-867.1, relating to recklessly violating a traffic light.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-867.1 as follows:

§ 46.2-867.1. Recklessly violating a traffic light.

Any person who drives a motor vehicle in violation of § 46.2-833 is guilty of reckless driving.

Hmmm. But, does it specify that violating a traffic light is inherently reckless? What if one were to violate a red light in a non-reckless manner. For example, if you stop/slow down, and no-one is coming from any direction, and you proceed through a red light, would that be considered reckless no matter what?

This is yet another instance of legislative stupidity.

If by running a red light a person causes, or almost causes, an accident that person can already be found guilty of reckless driving. Expanding the definition of reckless to include the orange light drivers, the slow roll right on red drivers and the nobody there drivers will only cheapen the meaning of the term "reckless". If the legislature really wants to make the legal consequences of running a red light the same as for reckless there is a better way: simply up the punishment for running red lights. It would be overkill, but at least it would be honest.

reckless is a felony - you lose the right to vote and several other civil rights

because you guessed wrong on the length of the yellow light and the red light camera caught you still in the intersection.
