Cary's free speech prohibits classic literature? Sounds fascist. Maybe I should try something more modern. Nabokov's "Lolita" for instance.

If you listened to the show on a regular basis BAcardi, you would know why Don talks about his parents the way that he does. They were mentally abusive and cruel towards him and his brother and continued to be that way long after he had moved out of their house. I'm sure that's partly why Don is the way he is now. That's neither here nor there though. The victim of abuse as a child is welcome to wish death on their abuser anytime publicly or privately in my book becuase there is no justification for treating a child that way ever.

Now you may think what in the hell is this guy talking about. Burning a flag what the hell man that has no relavance to this argument. Just for the people that like to study law, or think they do know all the laws, lets go to a supreme court case where flag burning was stated to be a protected way of free speach. Now some of us might know of Johnson vs texas. where a man burned a flag to show opsition to the 1985 flag burning law. This man was found to be not gulity and protected from the goverment. So is banning a manon a internet website, who puts i love don and mike over and over agian in the same rank as a flag burning case in 1985. I would think so.Now what is the first admendment, The freedom of speach, religon, petion, and assembly. Now dose this website condone that right. Or better yet a man that writes slander and then hides behind the sheild of the first amendment better than a man who writes i love don and mike over and over agian. Well the webmaster thinks that the man who writes slander is much more intitled to have the first amendment then the man who writes i love don and mike over and over agian. Now dose that make the webmaster a hyprocrite yes it dose. Hypocrisy Spotter makes a good point of showing that. Now people if we use are common sence we would be able to see that simple truth.And the truth is cary the so called 1st amendment defender is truley a hyprocrite with a agenda.

According to California Law
Title 13.

Section 451. A person is guilty of arson when he or she willfully and
maliciously sets fire to or burns or causes to be burned or who aids,
counsels, or procures the burning of, any structure, forest land, or
property.
(a) Arson that causes great bodily injury is a felony punishable
by imprisonment in the state prison for five, seven, or nine years.
(b) Arson that causes an inhabited structure or inhabited property
to burn is a felony punishable by imprisonment in the state prison
for three, five, or eight years.
(c) Arson of a structure or forest land is a felony punishable by
imprisonment in the state prison for two, four, or six years.
(d) Arson of property is a felony punishable by imprisonment in
the state prison for 16 months, two, or three years. For purposes of
this paragraph, arson of property does not include one burning or
causing to be burned his or her own personal property unless there is
an intent to defraud or there is injury to another person or another
person's structure, forest land, or property.
(e) In the case of any person convicted of violating this section
while confined in a state prison, prison road camp, prison forestry
camp, or other prison camp or prison farm, or while confined in a
county jail while serving a term of imprisonment for a felony or
misdemeanor conviction, any sentence imposed shall be consecutive to
the sentence for which the person was then confined.

It further defines in Section 450(e) "Maliciously" imports a wish to vex, defraud, annoy, or injure another person, or an intent to do a wrongful act, established either by proof or presumption of law.

So it can be inferred that, if the flag belonged to "another person" it would in fact be arson. HOWEVER, if the flag was legally purchased by the person/entity burning the flag, and the fire was contained and NOT allowed to burn further surrounding property or cause bodily harm, it would not be considered arson, and when compared in unison with the 1985 Johnson vs Texas ruling stated above it could be considered Free Speech.

now lets rebutal or argue. good point by the way and i must say i didnt know that. but mypoint is still basically clear. so yea u can fyi me all u want but if you read the whole message it is not about flag burning. the point i was trying to make that there is a connection. Like a similie or a metaphor. I was never attempting to state that flag burning is right in any way but just for kicks why dont u do some reacherch before you bring out the punches. Arson huh, ha i think that you must burn a structure or cause bodily harm to concider it arson. Now this is all theory but lets say im out in the nevada desert and i light up a flag so i can have heat for the night is that arson assmunch.

In your example of being in Nevada and lighting up a flag for heat, the only way you would be violating any laws with the aboved Texas/California mandates would be if you stole that flag from somebody else, then set fire to it. In which case you would be probably be charged first with theft, and then with arson. Otherwise, you'd be fine, even if you had a hidden message of protest attached to the act.

I began looking through Virginia state law to see how they define arson, and low and behold, Virginia's codes of law are written in a very complicated manner and are almost ridiculously specific to each individual piece of property that could be burned. A code for arson in a public building vs arson on private land vs that strange burning feeling in my nether regions. WAY TOO much information for the average citizen, but just enough to maintain job security for legal counselors.

In fact, the intent of my post was to strenghten the argument that ALL of the posts typed onto the servers of this site are exercises in Free Speech. To limit, censor, or delete any of these posts invalidates this site as being a Free Speech forum. Which would validate the fact that the moderators of this site are, in fact, practicing in hipocrisy.

I heard this site mentioned on D&M and have been lurking around the forums for a while, and I've seen both sides hiding behind "free speech". What you fail to consider is that with "free speech" comes the responsibility to use it in the correct manner. For example if I have Mr. Wiedemann's credit card numbers is it okay for me to post them on the internet under the guise of "free speech"? At what point do we draw the line between "free speech" and responsible speech?

I agree with much that has been said about Don, although I feel for the guy; no one should have to endure the premature death of a beloved spouse, and some of the messages that have been posted (Freda's Rotting Corpse, etc) ARE intolerably cruel.

But we live in an incredibly uncivil society, which has developed, in no small part, by the conduct of Don and people like him who constantly seek to push the envelope of propriety ever outward in order to shock and raise their ratings. If you can't be clever and witty, be outrageous.

As cruel and uncivil as he is, it is ironic that Geronimo, of all people, would not expect this, or would take exception to this childish, sophmoric type of behavior; it is his very stock in trade. If Larry King's wife had died, you can bet Geronimo would be on the air the next day, gleefully making jokes about her rotting corpse, with Mike at his side, chuckling and nodding as if every fart from Geronimo was a hilarious punchline.

Geronimo has made a living out of exactly this kind of behavior and has engendered legions of fans who have a taste for this type of cruelty. Is it any wonder that this should come back to bite him in the ass when the ox being gored is his? Hoist on his own petard, I think Shakespeare would say.

While I feel for him and his son, it is the ultimate in hypocrisy for him to condemn those who treat him as he treats others. And while I feel compassion for the man, enough with this drama on the show; if you're not ready to come back, don't come back; that would certainly be understandable. And if you are ready, and you state that the "grieving" is over, then shut the hell up about it and stop throwing yourself this daily pity party and acting wounded and walking out, etc. The comments that have been posted on this site would get very limited circulation but for Geronimo's reading them on his show in an effort to engender everyone's further sympathy for him. Don, you should recognize that you helped to create the kind of world that treats you this way, and go on treating others this way and raking in the dough.

Just my .02 cents, anyway.

Sure, somebody has pay them for legal counsel. Aside from District assigned attorneys, their salaries aren't paid by taxes. It comes from the individuals who seek their counsel.

I can't speak with 100% accuracy, but I did hear even the moderator of this site consulted legal counsel in regards to the privacy policy and liability of personal information attained from this website.

It could be pro bono. But often, nothing is free.
