CENTREVILLE, Va. (AP) - A Prince William County prosecutor has been arrested on drunken driving charges.

Fairfax County police say 32-year-old Douglas Marshall of Haymarket was stopped at 3 a.m. last Saturday on Interstate 66 near Centreville. Marshall is an assistant commonwealth's attorney for Prince William County.

Police say Marshall showed signs of intoxication and refused a breath test. Inside Marshall's car, police say the officer found an open beer can and a prescription bottle with one pill of percocet, a controlled painkiller.

He's been charged with driving while intoxicated, felony drug possession and other offenses.

Prince William Commonwealth's Attorney Paul Ebert says he's not suspending Marshall and likely wouldn't take any action unless Marshall is convicted.

Marshall's attorney says he anticipates a favorable outcome.

DUI's are not a joke in VA unless you are a cop or a prosecutor. They get people even without the breath test.

If you think you have been drinking to much, Never Never submit to a breath test, or do any the other tests a cop asks you to do.

This may be interesting to watch. Charging someone with DUI and/or a felony is not SOP when they are going to "lose the paperwork". However the fact that Ebert hasn't canned him indicates he expects at least the felony charge to go away.

Most of the prosecutors I've known are assholes anyhow, including the JAG ones.

First, we need a mug shot of this guy. Can someone get one???

Second, he was driving East bound at nearly 3:00 a.m. on I-66. Last time I checked, Haymarket was west of Centreville where he was caught.

Third, the percocet bottle that he had was a prescription in the name of another family member. It' wasn't his drugs.

Fourth, where the hell was he going at that hour?? Was he heading into Washington, DC to help Marion Barry find his stolen Jaguar??

Who know how many percocet tablets he had in his system, too. There was just one tablet left in the bottle when he was pulled over. The prescription was in the name of another family member. Percocet + alcohol = very intensified effects. If if the guy did take the breathalizer, he probably would have blown a .10. Yet, with the percocet figured into the equation, he would have been much above that.

the officer should have extended the same courtesy as is given to his brethren in blue.

I feel bad for him, I just pulled up the record and I noticed that the cop that arrested him also arrested me. I feel bad for him because other prisoners could probably see him and if they knew that he was a prosecutor, they would run a train.

A *prosecutor* prefers to get charged with refusal instead of taking the tests.

There was some debate about this on another thread. That settles it. If those who know the system think it is better to refuse, then everybody should refuse... or do that passive burping thing while trying to get yourself sobered up.

The Prince William county prosecutor pleaded guilty on 6/28/11 to reckless driving and drinking while operating a motor vehicle. All he received was a $750 fine. It seems to me if you are all white it is all right. I bet if he was black he would have gone to jail. Also he would have gone to jail if he had been a regular citizen. Since he is a prosecutor, he got to operate with impunity.

My guess is he has to do ASAP, but getting the Refusal Nolle Prossed was key. A refusal conviction would have taken his license for a year with no opportunity for a Restricted OL.

Yea. Getting the refusal dropped is a big deal. I'm not sure if you do better if you know the system, or know someone in the system, or know some lawyer that can make the system his bitch.

According to court records, he now has a restricted license and apparently he is still employed. This is B.S. had it been any other citizen, they would be screwed.

That's really messed up! I got DQed from Prince William County Police and all I heard was how everyone in their department and legal system maintained the highest standards and integrity and that there was no room for error. They're gonna make me feel like the biggest criminal and low life yet their assistant commonwealth's attorney can get drunk, snort pills, and refuse breathalyzer tests in Fairfax, guess their response would be "everyone makes mistakes." Yeah right tell that to your applicants you hypocrites! If this is the type of behavior from Prince William's assistant commonwealth's attorney I really wonder what the officers on their police force are either hiding or act when they're not on duty.

Unfortunately the Fairfax County Circuit Court does not have a free online database to search (while almost every other jurisdiction does).

I know first hand how crooked PW County Prosecutors are. My husband and I were victims of felony embezzelment by a former employee. She stole in excess of $100,000.00. We tried to file criminal charges. We were never contacted or interviewed by anyone from the prosecutors office. Our prosecutor, Clay Richardson, did however speak to the defendents attorney - in a closed door meeting at the courthouse - on the morning of the peliminary hearing - and advised my husband and I that he was dropping all charges. He was very uncaring, disrespectfull and in my opinion, almost hostile towards us....the victims. We supplied the Commonwealth with copies of 69 checks she had written to herself and the written report from the FORENSIC ACCOUNTANT who had investigated the allegations thoroughly. He had total cooperation from the Forensic Accountant and our Civil Attorney. Our Civil Attorney even came to court on her own - in case Clay Richardson had any questions. The Forensic Accountant, the Civil Attorney my husband and I all waited for an hour and a half.....for NOTHING !!! OH.......Did I happen to mention Clay Richardson is a former employee of the defense attorney ????? Sounds to me like a little bit of "professional courtesy" was going down behind closed doors. Shouldn't we at least be interviewed by the prosecution before they throw our case out ? Beware small business owners in Prince William - if your employees steal from you (and go to great lenghts to cover it up ) - THEY WILL GET AWAY WITH IT !!! As long as my taxes are paying for prosecuters that will spend hours and God knows how many hundreds or even thousands of dollars trying to prosecute a Spanish kid for - I kid you not - stopping too fast, while people are stealing hundreds of thousands from hard working everyday Joes like us - throwing out cases without so much as a courteous f*ck you very much - I think those people ( the prosecutors ) should be in some way made to answer to us. If I suddenly stop paying my taxes .... I'm sure the prosecutors will find time to haul me off to jail. Prince Willaim County is the worst county in the nation. It's prosecuting attorney(s), at least the one I've dealt with, Clay Richardson - is - in my opinion lazy, incompetent and WAAAYYY over paid ! Thanks for nothing Clay !!!!
