The ordinary rule in Virginia is that legislation takes effect on July 1. The legislature can delay the effective date of legislation easily enough. To advance the effective date it is necessary to follow the process for emergency legislation. The Governor cannot by fiat alter the effective date of legislation. He could try to have the bill amended, but that would require the approval of the legislature.

Until the new legislation takes effect, whenever that may be, the old rules apply.

Quick check. Virginia Code §1-214 and Article IV Section 13 of the Virginia Constitution says that Emergency Legislation can take effect immediately. It also says a 4/5ths vote of each house is required for Emergency Legislation.

And by "old rules", are you referring to executive orders that democrats signed or republicans? Because some places are checking signatures on executive orders before deciding whether to follow laws.

Next time VA gets a libtard governor, I hope the GOP ignores all of his executive orders that they don't like also.

No. I know of no reason why Youngkin could not rescind what Northam ordered. What the governor orders, be he Democrat or Republican, isn't decisive though. What matters is who has the power to decide under existing law. There are multiple possibilities here:
1) The Governor gets to decide
2) The local school board gets to decide
3) The governor gets to set the minimum and the local school board can impose additional conditions
4) The course of action is dictated by the findings of some outside entity such as the CDC.

The news reports indicate that the Arlington Circuit Court judge found "The law says that school boards must provide such in-person instruction in a manner in which it adheres, to the maximum extent practicable, to any currently applicable mitigation strategies for early childhood care and education programs and elementary and secondary schools to reduce the transmission of COVID-19 that have been provided by the federal Centers for Disease Control and Prevention.” It sounds like that the judge is saying it is a combination of 2 and 4. Whether that is a correct interpretation of what Virginia law actually says....

It is an interesting point. The language dealing with the effective date of new legislation is quite clear that a 4/5ths majority is required for laws to take effect before July 1. The language dealing with proposed modifications by the governor OTOH only requires a simple majority. Which prevails?

If I had to bet, the same school boards which are insisting on mask mandates will also deny the validity of legislation removing their authority on mask mandates before July 1, unless it passed with the required 4/5ths majority. That means the whole issue will be back in front of the courts.

Which law are you thinking of? I am only aware of one law passed by the Virginia General Assembly that Northan requested be implemented immediately that was not approved by a 4/5ths majority. It was something also covered by Federal law and Virginia Supreme Court rules, so I don't think the validity of the emergency status was challenged.

In a similar situation in the fall of 2020, Democrats used their superior numbers in both chambers to pass emergency protections for Virginians facing eviction when then-Gov. Ralph Northam added an emergency clause. Both chambers approved it by majority vote, over Republican opposition.

That was the only one I was aware of. To clarify, the Virginia Senate passed the legislation by more than a 4/5ths majority, including most Republicans. It was only in the Virginia House of Delegates that the 4/5ths majority was lacking.

It was a stupid idea and probably an unnecessary one. The Virginia Supreme Court already had an eviction moratorium in place. Then there was the problem that by not evicting nonpaying tenants due to the threat of covid they were preventing potential paying tenants from renting those places, and arguably putting them at greater risk of getting covid. Shield one group by exposing another.

The Virginia Supreme Court has already ruled on the matter of the law you are citing. A couple days after the Arlington Circuit Court case, a different case was brought to the Virginia Supreme Court. The basis of the Arlington case was that the law demanded the masking. And Virginia Supreme Court aready shot that down. So it's a forgone conclusion what will happen.

In the end it doesn't matter. The VSC can rule in favor of Youngkin. The General Assembly could pass something and have it take effect tomorrow. It doesn't matter.
