My employer is abusing the H1B visa program. What should I do?

I have three specific examples of my employer abusing the H1B visa program to bring over workers who cost less but require extensive training in order to do a job that I know for a fact could be done by US resources who were sitting idle at the time.

Should I report them through the new email for H1B visa abuse that the Trump administration set up?

My employer is a very large company and I'm extremely afraid of retaliation if I report anything, but at the same time I think the abuses are unjust and unfair to American workers.

What would you do?

Get someone who doesn't work there to do it for you.

These companies do this all the time. They send you a layoff notice. They're bringing in some guy form Inn-JAH to do your job for 1/3 the pay. About 3 days before your last day, your boss hauls you in his office and offers you another 30 days and a bonus if you'll train your replacement. You haven't been able to find another job, so you accept, cuz you still have to pay rent & the grocery bills.

The terms of the contract state you have to pay back everything if you leave before the 30 days are up or if your boss doesn't think you trained him right. They also hold the bonus (in other words, they don't give it to you) so your boss can "make sure you trained him right".


Here are the usual scenarios:

I. You get a "now of never" offer of a new job 10 day into it. If you take it, you have to pay back the 10 days. If you decline, you get the 10 days and the other 20. Really, you're better off accepting and making them work for their 10 days pay, because......................

II. If you finish the 30 days, they accuse you of failing to train your replacement right, demand back the 30 days and refuse to pay the bonus. Everybody gets a lawyer (the Co has one on retainer, so he gets paid whether he works or doesn't). You settle on keeping the 30 days but forfeiting the bonus.

A. Now you're really sca-ROOD, 'cuz now you have this legal bill that's more than the 30 days. If you got a now or never offer and took it, at least you have some income, so you can pay down the legal bill, eventually. Still you have a legal bill for something that got you nothing.

B. If you didn't get the now or never offer, you are now without a job, without the bonus you were counting on to hold you for another month and with a big legal bill.

III. Your replacement is a total idiot who barely speaks English and does not bathe, either. You tell your boss you can't train a guy like that. He fires you, the Co. demands back the money it paid you. You hire a lawyer you can't afford to pay. You're sca-ROOD, again.

Another month of pay and a bonus I'll never see to train my replacement? Uh no...fuck you, boss.

This is why one of your most urgent financial goals should be to always have 6 months worth of cash to cover bills and expenses in your savings at all times. That way you have that reserve there and if you're presented with the above scenario you can walk out without having to deal with training your replacement and other exit bullshit.

#2...always be networking with other people in your industry. Don't be a job hopper but keep as many lines of communication open as possible. Be professuonal and respectful to people in your profession. Even and especially those with whom you are currently competing with. I take at least one person in my network out to lunch per month and usually receive 2 or 3 offers per month in return. You never know when you'll be out job hunting. If you have built a proper network and have conducted yourself like a cold blooded, professional assassin...you'll have multiple offers within a few days and your job transition suddenly becomes a mini-vacation.

Agree to the terms your boss proposes. Meet your replacement. Begin to train him. Find out a little bit about him. Go to his ghetto house and slit his fucking throat. After the "ordeal" is over approach your boss and ask if he still needs your assistance since Rogan Josh is no longer available. Continue employment.

I believe all of this except the having to pay back the $$$ for work you've done. That'd be a pretty short court case, I suspect.
