I heard a rumor that you could be giving a ticket if you cuss at a cop? Does anyone know if this is true?

You can be arrested for cussing at anybody. That doesn't mean it'll hold up in court, but yeah, you can be ticketed/arrested for being an ass around an officer.

isnt the above describing something like attempting to incite a riot? oh... and the police are always right. so remember when you are being beaten that you did something wrong... like... asking a question or stating you have a specific right that they are violating.

Unless the cops are about to actually hurt you, you should probably not mention they are violating your rights. That way, the charge gets dropped in court a lot more easily. I've never understood why cops fail to do the simplest things like read someone's rights before questioning, but fail they do.

There's actually a whole list of things you can get ticketed for if you say them while talking to a cop, besides stuff like "shit" and "fuck". Here's a partial list:

Breaching the peace or disturbing the peace is many times used to as an infraction when someone pleas down from a misdemeanor. It means whatever the judge wants it to so it could be playing your boombox too loud or laying down in the street blocking traffic. Incitement is usually provoking people "like telling a crowd in a speech to go burn down a building" and then they do. If the cops want to arrest you they can and will. Remember you can be "detained" for 48 hours without charge at least as long as you're not an enemy combatant. Now I'm not a legal expert like some people on this forum so some of this may not be 100% correct.

Police don't have to read you your rights if you are under arrest or even if you're being stopped during a preliminary investigation. It's a myth perpetuated by television and movies. The only time you have to be read your rights is if you are not free to leave and are being questioned about a specific event. You can also be arrested and questioned about an unrelated event even if you've "lawyered up". But of course, all these sidewalk lawyers know better.

But just show respect to the cop. Giving him shit is pointless....You make his job harder therefor he skrews you over more, you also give him more behaviors he can describe to the judge while in court ...Its like you coming to my work and yelling at me....depending on how i feel i can either stick my foot up your ass or just take the bs and smile.

Just speak and handle things calmly and if you notice the cop is skrewing you over...do a load of research, get a lawyer and get infront of the judge and let it all out. If you do it in a calmly matter your rights will be given.

There is a class 3 misdemeanor that prohibits you from "cursing and abusing" people. Here it is:

ยง 18.2-416. Punishment for using abusive language to another.

If any person shall, in the presence or hearing of another, curse or abuse such other person, or use any violent abusive language to such person concerning himself or any of his relations, or otherwise use such language, under circumstances reasonably calculated to provoke a breach of the peace, he shall be guilty of a Class 3 misdemeanor.


They don't use it much, but it's there.

no it's not true

cursing and profanity in public (meaning the public can hear it and is meant to hear it) is not legal in VA. however people have cursing on their licence plates (which are removed) and often t-shirts (used to be removed if seen - today unsure if they are doing that)

nudity in public is illegal, except at designated places (the beach)

however if your being arrested - it's often in private (as officers often arrange for an arrest to be in private)


no it's not true curse words are illegal
