Local car dealer sold me a wrecked car!

It turns out a local Chevy dealer in the NOVA area sold me a previously damaged car that had significant damage from an accident. This was discovered on CarFax and never disclosed to me prior to making the purchase. I was never given a copy of the CarFax to review. I took their word for it because the car looked straight and had no outward signs of any prior accident damage. Drove straight, all body panels lined up correct and no paint abnormalities.

What responsibilities does a car dealer have in disclosing this information? What are my options? I was told by the salesman the car had a clean CarFax report which turns out to be completely false.

I don't think the OP is asking for advice on how to not let this happen. He/She is asking for advice on what can be done now, if anything. I'm not a legal expert but I believe a car dealer does have to disclose this information prior to a sale.

Not according to the post above yours! The dealership has an obligation to disclose material facts. Material facts would include serious accident damage.

If the OP gets this on TV and newspapers and smears the dealership's reputation, the sky is the limit on how much they will pay him to shut up!

You are a delusional...those TV stations don't give a flying fuck about some dumbass who bought a used car....just take it back to the dealer and threaten to drive it through the front window. I actually had a friend threaten do that at Koons Ford in 7-Corners...they took back his car.

This is an ad for a California law firm, and the advice is probably based on California law. These laws vary from state to state, so you should check to see what the requirements are for the state where the car sale took place.

same thing happened for mom at coleman motor sports in falls church buying a used nissan altima...

i camped out for the day talking to every customer coming in and after a few hours they agreed to take it back...
time has healed the anger, but they are back on my list after reading your post...

any way you can cause them pain, keep at it....post their phone numbers on sex hotlines, march out front of their store, call immigration on their workers-customers, and if 7 on your side calls (or a friend doing a good impersonation) even better

OP here, thanks for the advice ^

The real pisser is I really like this car and it seems to run and drive fine, no issues. I'm just not happy about the accident damage not being disclosed. I know modern body shops can fix almost any damage back to nearly new. I just dont like being lied to. And if the law says they have to disclose it, then that's what they should do. Still considering options.

In this day and age, everything gets reported to CarFax, even minor damage. If car dealerships couldnt sell cars with Carfax depicted damage, there would not be many used cars to choose from/purchase.

If the car was "certified" by the manufacturer, you may be able to complain to the manufacturer, IF, key word, IF that particular manufacturer doesnt allow the dealerships to brand damaged cars, as "certified"

What kind of car? Make? Model? Year?

If you drove it off the lot, its yours. You cannot take it back.

I learned some tricks the shady dealers do- mostly the shitty ones on route 1 run by Muhommad. If the ad doesn't include a carfax, it's wrecked. If you have to email them for a carfax, it's fake and the car is wrecked. If the price is too good to be true, it's wrecked.

I was interested in a BMW 335. No carfax on website. I called the guy, he says he can supply me a carfax if I went down there. No thanks. I actually "wasted" the $40 on a real carfax. Damn thing was wrecked with structural damage, but no air bag deployment. Pass. Good luck selling any car with carfax accident damage reported back to a dealer!

Keep in mind many vehicles have had some form of damage along the way. It's pretty normal.

If it was significant enough that you care, email the GM and other heads that unless the problem is remedied to your satisfaction, you'll leave detailed and scathing reviews on every website that allows you to. I left a bad Google review for the last dealer that I bought from and they literally repainted half of my car at no charge, cut me a check for what it cost to powdercoat my wheels, and gave me a loaner for 3 weeks.

Law says if they know the vehicle has been wrecked that have to disclose it. Period.

I had the same problem. Bought a car right there at an dealership not to be named right there by Fairfax Circle. Had to bring it back to them for many repairs after I figured out it had been wrecked by a milk delivery truck and also some assholes had keyed it.

At least I was there at Fairfax Circle so I could head over to Arthur Treacher's for some fucking awesome fish, chips and hush puppies! And a coke.

No. Your definition of "wrecked" is most likely not the same as VA. I am trying to actually help the OP, with my near 20 years in the industry, from salesman to General Manager of a CHEVROLET STORE IN NOVA.

Frame damage, flood damage, or damage caused while in the dealerships inventory, that exceeds 10% of sticker price (new) or 10% of NADA loan value (used).

To the OP. First of all, don't pay any attention to Car Salesman. Those snakes all stick together. For all we know, he's the salesman on your transaction.

2nd - File a complaint with the Consumer Protection Division in the Va Atty General's office. That will get the dealers attention. They cannot sell you a car they know was wrecked without disclosing this information. It's a violation of consumer protection laws.

3rd - Call the local TV stations. They all have consumer advocates that love to stick it to scamming car dealers.

4th - NAME THE DEALERSHIP! There is no reason to keep this quiet. They need to be punished.

I know there is a Virginia law which says dealers must disclose damage when they sell new cars. I have not seen anything which expressly requires those selling used cars must disclose damage. For those here who say the law requires this, what is your source?

Many accidents don't show up on the car fax report. The best thing to do before you buy a car is to get pre-purchase inspection from another shop. If the dealer won't let you get a pre-purchase inspection, go somewhere else. There are no shortage of nice cars in the DC area.

Well, progress being made. I have the dealership a little worried. I filed a complaint with the VA Atty General's Office Consumer Protection Division. And lo and behold they are now offering me a deal to trade my "wrecked" car in for a different one. Only problem is, they got nothing I want. But at least they have acknowledged they lied to me and committed fraud. I still want cash compensation.

#1 not all accident cars are bad. maybe the body shop fixed all that counts.

#2 you have to ask for carfax, i can tell you know that and are lying

#3 it's always been the law in the USA that one cannot sell a horse with a bad eye (without informing the buyer)

lies aren't allowed during sale

buyer beware means

a) if get your ass stolen the gov won't help you unless it's over $2,000 ($500 small claims is usually offered)

b) you are responsible for checking an item for OBVIOUS defects, but yet the seller if they know of hidden defects MUST inform you no matter what

git r done ! keep on them, but know when you have a good deal and don't get greedy...and report them to any online forums you can so their reputation costs the much more in the long run...tell them if they want silence, they are going to have to pay for it
