Reston Town Center and PARKING

Read two articles in the Fairfax Times about garages (Boston Properties) are charging for parking at the Reston TOWN Center.
Business' have seen a sharp decline in sales.
As predicted, many people, myself included, will never visit Reston Town Center again. Why should I? Their are enough good restaurants around town where parking is still FREE.

Merchants at RTC must be fuming!!!

No, all but two of the RTC merchants were in favor of paid parking and so far it is working out as planned. We want to keep people like you away.

If you need the App to get parking validated, I'm not going.

I don't like the paid parking, but if I need to go to RTC, it would not keep me away--but I strongly dislike the app idea. It should be easy to pay to park--not complicated.

I don't want an app I rarely use.

Go into BestBuy...buy some snacks from the point of sale area and keep your receipt. They can't tow you.

This is also useful for parking in the lot next to Herndon Festival. Although Herndon Festival sucks now so, there's really no need to even go anymore...

Even if you park and go into one of the stores near the Herndon Festival and then walk over to the festival they will tow you. Last year I did some shopping at the dollar store and didn't even know there was a festival going on until I pulled into the parking lot. Since I'd never been to the festival before, I decided to put the stuff I'd bought in my car and then walk over to check it out.
My car was towed.

I had to go to Fairfax to get it. I showed them the receipt and even the stuff I'd bought that was in bags in the back seat of my car. They didn't care.

They have uniformed guys walking around now putting these huge suction cup windshield blockers on cars when their parking's expired. It's called The Barnacle. You have to pay an exhorbitant fee for them to take it off, otherwise you can't see to drive. They're relentless about it too, very aggressive and in-your-face about paying the fees.

Have you actually seen or had first hand experience with them attaching those things? It seems like they would be easy to remove with a flat piece of metal such as a hacksaw blade, or take a long piece of wire and work it down the windshield under the thing to break the suction. I'm almost tempted to go try it out, and throw the thing in my trunk and drive off with it.

The devices are all equipped with GPS. When deployed, the authority notes the license plate, make and model as well as the location of the vehicle. These devices are installed when someone has parked illegally.

The owner of the vehicle will be responsible for the charges associated with being given the code to release the device. If you either do not return the device to the authority as instructed or if you tamper with or remove the device without making a payment and receiving the release code, you will be charged additional fees.

The authority is very aware of which devices have been lawfully disengaged and returned and which have been tampered with. Again, you chose to violate parking rules, laws and regulations. Nobody forced you to park there.

What are they going to do? If they put something on my car, I own it. GPS won't help much once it leaves their property. I'm curious if they have a cellular phone transmitter though. It might be fun to disassemble one and find out what's inside.

If they ask nicely I might consider mailing it back to them after I'm done playing with it, at their expense of course.

I'd like to see someone drive off with one and argue that once the device was installed on their vehicle, it became their property. It would make for an interesting case.

Furthermore if the parking garage is installing a device on a person's car with GPS tracking, did they consider United States v. Jones? In that case, the Supreme Court held that "the Government's installation of a GPS device on a target's vehicle, and its use of that device to monitor the vehicle's movements, constitutes a 'search'" under the Fourth Amendment. The Court concluded that the Government's installation of a GPS device onto the defendant's car was a trespass.

Interesting thought. Note that US v Jones was *government*, so it will be at least somewhat different. RTC is private property, so I'm not sure they can trespass on your property on their property. Would be a VERY interesting case!

After reading the state and county laws, I would feel most comfortable rolling down the window for visibility, driving to the exit, then removing and leaving the sucker thing there (making sure to take a picture documenting where I left it). You could throw it in your trunk if you want, but they would want it back.

it's hard to do though, the reston town center cops get all in your face and act threatening. i think earn make commission off thsee barnacles which ratchets up their aggressiveness, and they work in packs. they show up in numbers if you're parking is expired and barnacled.

They are private security guards. They can't do shit, so let them get as aggressive as they want. In fact the more riled up they get the better. They have no right to stop you from driving away.
