Can you prepay a Reckless Driving ticket in VA?
Posted by: 1 Adam12 ()

A friend of mine was in an accident back in early November and got a ticket for Reckless Driving from the VA State Police. He was definitely at fault in the wreck.

He has a court date Jan 6th (Friday) and he asked me today if he could just pay the ticket and not have to waste a day in court. The first thing I said to him was "Why have you waited until this week to deal with this?".......Yes, he's something of a retard.

It's always been my understanding that a Reckless Driving ticket always require you see the Judge. Am I wrong? I dont have any 1st hand experience because I dont get Reckless Driving tickets as a rule.

I do know if you have a good record you can pre pay minor shit like speeding. I've also heard of people getting a jail sentence for Reckless. Like I said, this guy is kind of a douche bag and he really should have spoken to a lawyer about this.

Yes your pal has to go to court and he better have a lawyer, Reckless can be up to 1 year in Jail although that is rare . Look for a 90 day loss of license too.

That's what I thought. I dont know about his driving record because, frankly, I'm afraid to ask. I'm sure it's not good.

Your lawyer can go in your place, you don't literally have to be in court.

Odds are they'll reduce it to simple speeding, you might catch a fine but nothing serious

I just spoke with him on the phone. He has made no attempts to speak to a lawyer as of today. Also, he wouldn't tell me what prior tickets he has, but he has minus 8 points on his license. I think he might be fucked.

word, did he mention how fast he was going? An 82 in a 65 zone is vastly different then a 90 in a 35, and I think technically anything over 80 is classified as a reckless in VA.

He wasn't speeding. Caused an accident by passing stopped traffic on the shoulder of a 4 lane highway. He got to an intersection and crashed into a car that was stopped at the red light. I told you he was a fucktard!

Why do you guys keep talking about speed? The OP clearly states the guy caused a wreck and was cited for reckless driving. Unless you think he was getting pulled over for speeding and then crashed of course. That would be quite a leap.

As for prepay -- not for reckless. The ticket/summons will also clearly state if you can prepay or must appear. There's a checkbox just for it. It's not really confusing at all.

I don't think that you can prepay the ticket, but my info is from 20 years ago or so.

Friend got nailed for doing 54 in a 30 mph zone, IIRC. Over the speed limit by 20 or more is (was at the time) reckless driving.

Lead-foot friend hired attorney for reckless driving charge. He was scared that he was headed for jail, although he had no significant prior tickets, no arrests, no criminal charges.

I told him that since there were no drugs or alcohol involved and no drag racing on road, the judge would not send him to jail. (I didn't allow for the Jason Werth situation: going 115 in a 55 mph zone & getting minor jail time on weekends even w/out drugs, alcohol or drag-racing.)

Judge sentenced friend to $500 fine (this was 20 years back) and several points on his license. Since he had zero points, he kept his license.

Your friend might be a different situation b/c there was an actual crash. So maybe the judges look on that differently?

Funny story unfolded in court waiting for my friend's case to be called.

Another guy charged with reckless driving for 20 or more over the speed limit came before the judge.

Charging officer testified first. Cop: "He was going 50 in a 25 mph zone. I pulled him over. He apologized to me & said that his car was malfunctioning. When he turned on his heater, his car accelerated." There was laughter in the courtroom audience upon hearing this.

Cop continued: "So I told him to restart his car & leave it in park. I then told him to turn on his heater. When he turned on the heater, I could hear the engine speeding up. I couldn't believe it." More audience laughter.

Judge says, "I thought I had heard every excuse possible, but this new to me. OK, you people in the courtroom, I don't want you telling anyone about this. I find you (defendant) not guilty of reckless driving, but will fine you $50 for improper maintaining of equipment. Get that fixed right away."

That's a lot less than the usual several hundred dollars for reckless driving.

That judge and courtroom were in part of VA remote from NOVA.

I wondered if the driver had some hidden control (magic trick?) to accelerate the engine and was fooling the cop & judge.

[I also thought the judge would ask the guy "how long has your car been doing that?" If the driver told the judge that it just started within a day or two, then I could see the guy skate with a $50 fine.

However, if the guy says, "it's been like that for several months or years," I would think the judge would still convict on reckless driving. I could imagine a judge saying "It's your car. Fix it so you can comply with the law or you pay the price."]

Judge just zipped through the case & the guy's excuse pretty much worked.

So this is what's going to happen:

Your friend will get called to the stand, the Judge will ask if he has a lawyer. Your friend will say no. The Judge will say do you want to get a lawyer or have one appointed to you. Your friend will say yes I will get a lawyer. The judge will ask the arresting officer for a new court date. Your friend will need to get a lawyer.

If your friend say's no I don't want a lawyer, your friend will need to grab his ankles and spread his cheeks far because is about to get fucked.

It's that easy.

Reckless in Virginia is not a traffic citation - it's a criminal offense.

If he's smart, which it sounds like he's not, he should show up early and talk to the DA. Most of the time they will reduce the punishment if you cooperate. It speeds things along for everyone involved. Been there, done that!

-Reckless driving tickets are payable at any 7-11.
The court has representatives at all locations.
Just approach the rep who will be standing outside.
Sometimes multiple reps are available. Mention that
you have cash in your pocket and need to make a payment.
They usually reduce the fee if you speak in Spanish.
Don't worry about a receipt.

If it's FF County, he can show up early all day, the DA won't talk to you for a reckless charge. If you have a lawyer, the DA will speak to the attorney. If not, you gotta wait and see the judge. It's no laughing matter. I got a total BS reckless ticket and was warned to hire a lawyer. I saw at least 10 people walked out of the court room in cuffs on their way to do jail time for reckless driving. I was told I got off early with a 6 month suspension and $1000 fine. For what it's worth, the cop even told the judge he made a mistake by writing the ticket and the judge still found me guilty. It's a complete money making shakedown.

I got pulled over in Orange this weekend after I swerved out of the way of some jackass turning into my lane without his signals. Within seconds, I saw lights behind me. I thought I was getting pulled over for changing lanes (without a signal) but was informed I was doing 68 on a 35mph zone. I was floored. I thought it was odd considering I was going the same speed as everyone else on the road. I have a court date set for mid March, and am wondering if I got snagged with this charge because I'm from NoVa.

Ignore DAJAX, he's often wrong about just about everything. You're friend's a retard and so are you, there's no such thing as "negative 8 points" on your license.
