Meals Tax Now Faces Flank Attack

At least one major restaurant supply company has decided to follow the lead of restaurants and supermarkets with respect to the meals tax.

This company will be giving employees residing in Fairfax County time off to go and vote against the tax on November 8th. This company sees the tax as bad for business. They fear that restaurant closings will follow the enactment of the tax; even if restaurants do not close, they have concerns that a decrease in restaurant business would mean a decrease in orders.

In the meantime, the pro-tax movement is having very little, if any luck in attracting supporters.

Weak 2nd quarter earnings reports from the restaurant sector point in the direction of a possible recession within the entire restaurant sector. I am sure that these reports have restaurant franchisees less than thrilled about a 4 percent tax increase in Fairfax County. Among some of the reasons for the DECREASE in earnings for the quarter analysts have pointed to a gradual increase in the cost of gas which has been fueling the earnings for the past few quarters, possible recession in the future and maybe more importantly a trend of families choosing to stay at home and cook.

FCPS is going to have a hard time getting restaurants to come out in support of this tax.

If Pat Hynes keeps making derogatory comments about restaurants opposed to the tax, she'll get sued and the restaurants will band together to defeat the tax.

I could also see a company like Heinz coming out against the tax, as restaurants buy their products.

This is a tax with a lot of potential enemies and very few friends. It was rushed onto the ballot because Karen Garza had a hissy fit.

The proposed meals tax is under attack again.

This time, the assault comes from within.

It is an “inconvenient truth” that even if the meals tax were to raise every penny that is claimed it would raise, it would not be enough to address the alleged budget shortfall FCPS used to get the Board of Supervisors to put it on the ballot.

So now, various groups are already fighting over the money, even though the tax has yet to pass, let alone realize any funds for FCPS.
In general terms, various “special interest constituencies” within the FCPS universe are already trying to lay claim to the money.

One such constituency is the athletic constituency. They are calling for reduced sports fees, expansion of certain sports programs, and dedicated funds for athletic facilities (read “turf fields”) upkeep. A closely related, indeed a possibly symbiotic constituency is the marching band constituency. In addition to wanting to minimize funds for band participation, they are seeking funds to legitimize the entire notion of marching band in the face of criticism, such as its lack of musical diversity and an alleged coverup of the pederasty of Laurence Einuis.

Then we have the “my kid needs to get into TJ/Harvard” constituency. They are calling for preservation as well as expansion of language immersion classes, a revamp of the international baccalaureate (IB) program and additional classes in science, technology, engineering, and mathematics (STEM).

A bit of a change emerges when the constituency of FCPS employees is examined. They want pay raises, better benefits, and more opportunities for professional advancement. The latter, of course, is a well known code for travel.

Finally, we have the school board itself. They want to retain the ability to vote themselves a raise, so they need to make sure the money is there to fund these raises. In addition, they are seeking protection of their **entitlement** to training, which, of course, is a well known code for travel.

Where I work we often order lunch out from one of those multi restaurant food delivery places.

Today's delivery came with an anti-meals tax brochure. Prices will go up by the amount of the tax if it passes. It also said that since they get the food from restaurants (all they do is deliver), they are looking for guidance as to whether there would be two taxes.

Finally, they said they were working with a coalition of restaurants and delivery services to defeat the tax and are encouraging their clients to do the same.

And no I'm not naming them as I have seen what Pat Hines has had to say about other businesses that don't go along with this tax.

I think that most Fairfax County parasitic workers (including cops and firefighters) support this tax. They want to line their own pockets, at the expenses of the county taxpayers.

We need a backbone, and have a BOS who can re-negotiate contracts with these guys who retire at 40 years old, only to hold 2 and 3 more jobs during their "retirement".

That model is old and busted.

The old, fat cops, and old, fat firefighters are all retiring. We need new, young, lean cops and firefighters, who know how to fund their own private retirement accounts.

Assholes just need shit-claims to pass around, since they have no actual facts to put forward at all. What has been claimed -- AND WHAT ASSHOLES CANNOT DENY -- is that the meals tax would bring in about $100 million in new revenue every year, a hefty portion of that coming from tourists, commuters, and business travelers, plus local fat-cats who dine out often and at the posh end of the local dining scale. For every one else, this is money that will NOT have to come out of the local property taxes that we all pay.

Since there is well organized opposition to the meals tax and very little support for it, it will not pass.

At that point, the Board of Supervisors will be backed into a corner and they will start cutting the FCPS budget. If FCPS really wants to hire the unlicensed quack Tara Brach, they can eliminate some other expenditure. It will become a very stark zero sum game very quickly.

Yes, the County grows and evolves, but eventually it will run into a limit-no more money.

Also, as the County evolves, it will get rid of things it no longer needs and learn from its mistakes.

The pro-meals tax people (including YOU) make vague statements about who supports this tax. Apart from 2 restaurants, not even in Fairfax County, who else has come forward? In fact, if some FCPS parent decides that the money will end up going to fund another student representative to the school board instead of a Japanese class, that parent might not vote for the tax!

Be careful-FCPS may be on thin ice bringing in an unlicensed person to do this mindfulness stuff. Virginia can be pretty strict about practicing medicine without a license. The fact that Brach appears to have done nothing to correct characterizations of her as a psychotherapist could be very problematic.

That is a nice circular argument you have there. By definition anyone who does not support the meals tax is not a knowledgeable and sensible person, and their views can be dismissed. There are individuals who oppose the meals tax because they are ill informed or because it is against their self-interest. There are also individuals who favor the meals tax because they are ill informed or because it is in their self interest.

Advocates of the meals tax bemoan the fact they have to get it approved by the electorate, and point out that certain other counties didn't have this requirement. While other counties didn't have to get it approved by voters, most were required to have it approved by the unanimous vote of the Board of Supervisors. I believe there are at least two supervisors who would oppose this.

Advocates argue it will shift some of the tax burden off of property owners. However nobody in the county is arguing that tax rates should be lowered in a meals tax was imposed. Some projections indicate that property tax rates will be increased even if the meals tax is imposed.

Advocates of the meals tax say it hits those who reside elsewhere which is true. Under the most optimistic projections though only about 28% of that money is going to come from those who reside elsewhere. The overwhelming majority of the funds are coming from those who live as well as work in the county.

Advocates of the meals tax argue that it hits fat cats eating at fancy restaurants. First that overlooks that individuals who eat at restaurants are already paying a sales tax of 6% on their meals as opposed to the 2.5% paid at the grocery store. Second it overlooks that the meals tax isn't just being imposed on meals consumed in restaurants. It is being imposed on all items considered "meals" sold for consumption elsewhere. The main people hit by this larger definition are lower and middle class individuals who get carry out because work or activity schedules prevent them from making meals at home.

Advocates of the meals tax do not advertise that the tax will actually hit a number of sales that most people do not think of as "meals". Pick up salad from the salad bar rather than buying individual items and you will be hit with the meals tax. Decide to pick up a soda and you may be paying the tax as well. How about that pre-cooked chicken from Costco or Safeway or a one ounce bag of chips?

There is the impact on the vendors. At the moment they just have to decide whether something is subject to the 6% sales tax, the 2.5% sales tax or nothing. With a meals tax the establishment might be having to impose sales tax of 10%, 6%, 4.5% or 2.5% or nothing. An honest vendor who guesses wrong could be faced with having to come up with substantial sums. A dishonest vendor could collect tax at one rate and pay it over at another.

Advocates dismiss opposition as uninformed or self interested. The same is true of support for the meals tax. A number of teachers have been talking it up because they see it as a way to fund pay raises. Others supporters favor it because it will be used to create or expand programs they want.

Advocates of the meals tax argue that without more revenue the County cannot continue to provide services that it currently does. On this one point they are absolutely correct. What they miss though is whether the County should be continuing on its present course, or whether it should pursue another IS A DEBATE WE SHOULD BE HAVING.

The groundswell of opposition to this tax keeps growing. The school board is besieged with inquiries about how the money will be spent and why certain expenditures were made. The board of supervisors is receiving many requests for information about the alleged "tax relief" program associated with the meals tax.

The citizens are not getting the answers they are looking for-so they have decided to vote NO on the meals tax.

The fact that Pat Hynes, a school board member, has gone out of her way to criticize restaurants not supporting the meals tax has outraged a great many people.

In fact, it has upset not only people who had not yet decided how to vote, but those who were considering supporting the tax as well. The result would appear to be that this tax will be defeated by a large margin.

And what can FCPS do about that? Nothing. When a kid shows up at the school, the school is legally bound to teach them. So you can bitch an moan about illegals all you want, but there is nothing FCPS can do about it.

We all have choices in life my friend. If every school across the nation refused to serve illegals, what do you think would happen? Obama would bitch, threaten lawsuits, and probably file law suits. Then you make another decision to ignore any summons, and stand your ground. This movement would no doubt have the backing of the vast majority of the American people. You would see all of the various law enforcement agencies start to step up the rounding up of illegals and deportations would increase. A clear message would be sent and they would start packing in droves. We all need to do our part. Do your own yard work, and report your neighbor's and businesses that are using illegals.

Unless/until the law is changed, a kid born here of illegal parents is legal. Imagine the lawsuit(s) over turning away legal kids.

Also, turning the neighbors in leads to the creation of a police state.

Immigration is a problem, but these are not good solutions.
