The primary question it would seem is is it legal for an undocumented person to live in Fairfax County. If not then it would seem the landlord has the right to refuse residency to someone breaking the law so long as they enforce that covenant equally. Would the landlord have the right to not renew if they knew a tenant were behind on child support? Outstanding and excessive fines and tickets?

The other integral question is the power of the lease over occupancy. The lease can legally limit and control who resides within the premises so long as it comports with laws. Are undocumented persons a protected class?

I suspect the landlord will prevail in choosing not to renew the lease assuming that the landlord applies this equally among tenants and prospective tenants and does so sole based on ability to document legal presence in the US.

We did have his birth certificate and social security card but no photo id.

When they wouldn't budge, I told them to just close my accounts now and cut me a certified check and we'll be on our way. They then opened the account for my under-documented kid.

This won't work if you have a balance of $1.39 like most people. I had over $200K on deposit with the fuckers. They didn't want to see it walk out the door so they bent their rules.

Cool, I really felt like telling them to fuck off on the spot. We have over 25k in the bank and I have been banking there for 5 years. It really pissed me off they wouldnt accept my sons birth cert, ss and my photo id. Fuckers. Problem is its the best bank Ive had in this area up to this point. WEll that is what we did same day but when you say 'all you had to do...' - Im not made of time during the business day. I carved out an hour to sit down with my son and these bank morons, that turned to 2.5 hours with our little trip to the DMV. In addition, they dont issue the minor id cards same day, it takes 8-10 days to get the card so that will be another 1 hr. trip to the fucking bank.

They can't.

They are required to under KYC rules to identify their customers. If they let you set up an account based on some dude rolling in off of the street without the proper ID, then anyone else could do the same for whatever nefarious purpose they may want to use it. They would have been more than happy to open the account in your name based on your own valid ID.

Landlord have a right t4o run background and credit checks on their tenants. Social security numbers are required to do this. When did this change?
