The new acting Police Chief said, "The chief made bad a decision." Huh? You don't hear that said in court when they pull over other people for DUI's.

Probably the only reason he is actually be charged is he hit another car in his unmarked. Tough for the Police to let him go when another driver is a witness to him being drunk and there is an accident caused by the Chief.

As usual this case will get thrown out of court on some "technical issue."

If one's blood alcohol level was between 0.15 and 0.20, there is a mandatory 5-day jail sentence. If the level was above 0.20, there is a mandatory 10-day jail sentence. In addition, if one had a blood alcohol level of 0.15 and above, he or she will be required to install an ignition interlock device on their vehicle.

Yes, he did.

His first mistake was excessive consumption of alcohol. There is a big difference between a .08 and a .19. He was genuinely intoxicated.

His second mistake was to take the blood test. As any rookie cop knows, refusal of the blood test can make the DUI charges harder to stick in court although doing so results in another charge; that of refusal.

It's interesting his level was reported at .19 I'd like to know the time difference between the time he was arrested and actually tested. I'm sure the cops cut him every break they could.

He most likely took the blood test because it is usually lower result than the breath test. Or, maybe he did take the breath test and it registered over .20 so they then did a blood test.

claiming whiplash and actually having a court appointed physician confirm it are two different things.

But you can't blame her, he hit her with a city owned vehicle, and he's the chief of police. She probably thought she hit the jackpot (or got hit by the jackpot, I suppose.)

I do feel for the guy. His face has been plastered on every news channel this morning. I wonder if he will resign. Alexandria does have a little of an allowance for DUI's. They let the School super stay after her DWI.

Still don't get why he didn't do what the Fairfax County officer arrested for DWI did when he had his accident and refuse to blow. The Fairfax officer had almost the exact same incident where he hit a truck after a night of drinking.

The Fairfax County officer refused to blow and the case was thrown out without any charges.

For him getting locked up for this bad enuff, but it would have been worse if he had refused the test. If you refuse to blow into the machine, you just get charged with a refusal. I believe the only time someone gets taken to the Hospital to have his blood drawn is, if they have a medical condition that would prevent them from blowing into the machine, or something like that. I never understood the reason behind for refusing. Even if you blow x2000 the legal limit you can only get charged with DUI, but refuse it and you get two charges. well, thats just me.

NO, if you refuse in VA that ends the tests. You do lose your license for a 6 month period but you can not be convict of drunk driving, you are convicted of DUI refusal. This is how the Fairfax Police Officer beat his DUI charge.

In some States refusing means that you will be blood tested against your will anyway, not in VA. Being testing against your will is considered unconstitutional in VA as your right to not incriminate yourself is broken.


FYI - I didn't mean to imply that refusal gets you off scott free, many insurance companies and employers see this as DUI conviction.

The Mayor of Alexandria was on the radio this morning making excuses for this asshole. HE HIT ANOTHER CAR AND INJURED A PERSON!

That right there is grounds for immediate dismissal, in my mind. This isn't a guy who blew .09 after one too many beers. This is a drunk driver who very likely could have killed someone...who happens to be in charge of enforcing drunk driving laws in Alexandria.

If I lived in Alexandria, I would be reaming the Mayor a new one right now.

Yes, you can be "charged of DUI and refusal" however it is difficult to CONVICT a person of "DUI" without any .?? What, just make up a random .?? number? and convict them based on that? Where's the evidence?

Both Sean Taylor and the FairFax Police officers caught have done this and they only got refusal.

The one Fairfax Police officer who refused is still on the force.

theres such a thing as probable cause. not every...(or any), drunk is stopped at a checkpoint or found after an acc. cops do sometimes... now brace yourself, cops do sometimes actually do some work and actually see these fools out on the roads swerving and generally being nsafe behind the wheel. its their witnessing the driving behaviors that gives them PC for the stop. then they can also see the persons general demeanor, if they are slurring their words and falling over ect. plus the sobriety tests. they can arrest u for dui without having u blow and cn convict u in court based off the officers testimoney as a witness to ur behavior! so just telling ppl that if u refuse u beat the dui charge is like george bush stupid

Whiplash isn't uncommon and I would imagine that it is rarely a serious injury. I had whiplash after my golf was hit by an f350 pulling a trailer. I was sore and perhaps a little disoriented. But I was fine within a few days. So I don't understand why your initial reaction is to distrust the woman.

I was in an accident once and had whiplash. I didn't notice it at first. About six months later I had this constant crick in my neck and on certain days couldn't turn it to the left. I had this problem for a couple of years. It eventually went away on its own. However, I had a friend who was rear-ended and she ended up having to go through massive physical therapy as a result. It comes down to how hard the vehicle was hit and whether or not the driver was aware of the impending impact and braced for it, or not.

Whiplash can depend a lot on the design of the car seat and headrest. The further back your head travels to the headrest in an accident, the more whiplash you will suffer.

The lady he hit is probably one of those who comes to a complete stop on the on ramp before getting on the highway to see if there is a car coming.

The chief probably looked over his shoulder to check for traffic and then looked back to see a stopped car in front of him on the on ramp.

Lurker... They get charged on 18.2-266 and you add the charge of unreasonable refusal. The officers testimony on the fact that you were intoxicated is what the conviction is based off of. The only the that the b.a.c. test goes for is additional evidence and helps determine your actual b.a.c. to see how drunk you were... but Ive gotten many convictions with a refusal. Drunk is drunk and so long as officers use their training to articulate how you were there is no way around it.... sorry Lurker... better luck on the next one....

My brother, who is a lawyer thinks differently. I have also talked with many hardcore habitual DUI offenders and they think differently also.

So what is the charge? DUI .08-.10? What is the penalty?

I still think a refusal by the Chief would of been better than a .19

@FYI - I like to drink, but when needed I crash at a friends, have a DD or take a taxi(usually $12, bargin).

The defense team is excellent. Word is, he defended a High School coach who was out drinking with a bunch of High School girls this past year - Coach kept his job. So it is his speciality to defend drunks.

He probably will get his job back or the Chief will be a coach at the High School.

He's a first time offender with no criminal record and 5 days is the mandatory minimum. He also pled guilty, and thus waived trial and the right to challenge the authenticity of a breathsheet against him. He didn't force a trial at taxpayer expense which he has every right to do. He didn't hide behind a defense attorney for something he knew he did anyways like you would do. You do realize brainiac that if his BAC was lower than .15 he wouldn't have done a day in jail. So by all means limpdick, explain why you think it's bullshit that the man stepped up and took his punishment like a man and admitted he did something wrong. I know it's difficult, but maybe try doing it without one of your lame-ass copy and pasted cartoons, or a donut or carwash comment.

And oh by the way, didn't have any connection to Fairfax either.

I'll go on the record and say the Chief took his DUI like a man. I actually feel a little sorry for the guy.

Surprised also that the judge handed out the full sentence to the Chief. I wonder if the judge was a little pissed at the Chief for making such a mockery out of the City and driving a "city vehicle" at the time.

How many judges suspend 175 days of the sentence $1200 in fines and give the minimum available by law to the average Joe??

Even if they have no record and plead guilty.

Where's MADD and citizens DUI patrol when you need them?

Anyone who doesn't think this is preferential treatment?

The judge suspended 175 days of the sentence, meaning Baker will have to serve the mandatory five-day minimum sentence for driving at such a high level of intoxication. I don't feel sorry for him but this continual need I see from people for the most extreme punishments to be given out... I mean, shit, it must be great to be so fucking perfect and know better than judges.

I personally don't believe punishments need to be extreme in every case but a double standard of any punishment nullifies all punishments.

And it's not punishment, it's rehabilitation remember. The best way to make criminals stop commit crimes is to lock them in 5' x 9's with other criminals where they can network and perfect their skills of law breaking with fellow enthusiasts.

But I'm guessing he didn't get a maximum sentence because he spent 19 years of his life serving the community. It's not like he's Mike Vick or something.

Yeah and for the record I'm not pro-cop. I got my first DWI two years ago and it was after I rear-ended a car in front of me. I got no jail time, ASAP, a suspended license for a year and paid about $350. And I was happy about it because I deserved it. But as my lawyer told me it was a standard sentence. So quit crying about it just because he's a cop...get over yourself.

I'm glad that he plead guilty and received a somewhat typical sentence. However, I don't feel sorry for him. If anything, I wish that the minimum punishment was more severe for anyone with a BAC that high.

I suggest everyone buy a breathalyzer. They are a hell of a lot cheaper than a DUI.

Feel sorry for him? He is suppose to uphold the law. This is not just a beat cop, he was the chief of police.

Suppose he killed someone? He ran right into her car on an exit ramp - failed 4 field sobriety tests and tested at .19 -- over twice the legal limit.

No sympathy here.

I think this is one of the rare instances where justice was served in terms of a member of law enforcement breaking the law. I feel bad for the guy because he squandered in one night what it took him 40 years to build. I don't feel sorry for his quitting or for his punishment.

Would you feel bad if if he killed someone? I think not.

This man is in his mid-to late 50's. Old enough to know better. Lord knows how many times he has driven drunk. I highly doubt that this is "freak occurance"
This is the fist time he got caught and the only reason he got caught was because he was not in Alexandria. Believe me, this guy has been lucky.

How is the Chief suppose to perfect his drinking in jail? This is only going to decrease his tollerance level. When the Chief gets out, one beer and he's drunk as a skunk. (Whatever a drunk skunk looks like... never seen one)

We should be building his tollerance for alcohol so he doesn't hit other cars again. At least a 12 pack a day.

I think I've proven that breathalyzer is useless. LOL Nobody is going to stand around for an hour after drinking waiting to see what their BAC is before deciding to drive home.

Even after just one sip of the margarita that thing was .18

Now if there was a way to get an accurate reading instantly that would be a different story.

Lurker, you were so drunk the night we tested that breathalyzer, that I must say you have zero credibility and that you don't know shit about how anything worked that night. At one point, you weren't even speaking intelligibly. I haven't seen someone that drunk since college.

The handheld is a very good tool... it works well. It requires half an hour and that stuff about the margarita sip affecting it is Lurker's way of introducing exaggeration into this to make his point.

In VA a 3rd subsequent Dui and you are required to install breathlyzer in you car for you condition sentencing. You blow into it, or the ingnition won't start. I dunno if Arlington Count is gonna require him to install one. Or was it for habitual offenders, I dunno.

I can't see people at a bar, dinner or party saying, "Ok I'm ready to go now I'll just hang around for half an hour and not drink anything while I wait to use my breathalyzer."

As for the car breathalyzer, the judge can order a car breathalyzer for a first offense depending upon the BAC. The car breathalyzer records any attempt to start the car with alcohol on your breath. The results are turned into an office and reviewed. Just one attempt and the offender could be facing more penalties.

Most people have stopped drinking within 30 minutes of leaving, so they don't have to wait to check their BAC.
