Fairfax Boulevard / Lee Highway – On April 3 at 2:56 AM an officer observed a subject slumped in a running vehicle standing in a traffic lane and subsequently determined that the subject was intoxicated. Luis Crisanto Rosales Estacio, 40, of 5663 Derby Court, Alexandria, was transported to the Adult Detention Center where he was charged with driving under the influence of alcohol and refusal of blood/breath test. His bond was set at $2500.

You can get a dui Drunk Asleep in your car parked on the street so long as the keys are inside the car and you admit to driving the vehicle at some point (and of course you blow over the limit). Drunk Asleep with the keys in the glove box = dui. Drunk Asleep with the keys in your pocket = dui. Drunk Asleep with keys in the back seat = dui.

If you are Drunk Asleep in your car hide your keys outside away from the car where the police cannot find them. If they wake you up do not admit to driving the car at all - tell them someone drove you there and left you on the side of the road and took the keys. Tell them you were driven there and you lost the keys, maybe your friends took them. Tell them a stranger from a party drove you there, you got in an argument and they got out of the car and left you. you may get drunk in public but better and cheaper than dui.

However, should a client irresponsibly drink and drive but then decide to responsibly pull over and sleep it off in the car or if one really was not driving, the following sugges­tions could prevent that individual from being convicted of driving while intoxicated:

Park in a spot that is designated as such, i.e. in a parking lot or on a road where parking is permitted. Avoid parking on the shoulder of a major highway if possible.

Turn off the car and take the keys out of the ignition. Do not turn the engine back on unless you start to develop frostbite (at which point you must decide whether your license or your toes are more important).

Get out of the driver's seat. Sleep it off in either the front passenger seat or in the rear of the car (fogging up the windows is optional).

When approached and questioned by the police, do not make any admissions or statements of intent to drive in the near future.

Keep some empty beer cans in the trunk. The "glove box defense" allows attorneys to argue that there is doubt as to whether the driver became intoxicated before or after the vehicle was placed in park. It is always better to get convicted of Consumption of Alcohol in a Motor Vehicle, in violation of N.J.S.A. 39:4-51a, rather than Driving While Intoxicated. The former does not carry a suspension of driving privileges.
