Operation Shoulder Tap
Posted by: GMU Hokie ()
Date: June 17, 2009 07:07PM

Possession, purchase or consumption of alcoholic beverage is prohibited by state law for anyone under 21 years of age.

Is soliciting someone to purchase alcoholic beverages for someone under the age of 21 prohibited by law?

So if it is against the law to solicit, why does FCPD conduct Operation Shoulder Tap?

It is entrapment. Look, If Gravis is walking into 7-11 to get his porno and blunts and minding his own sick perverted business - he has no reason or intention to break the law. If someone "taps him and says "hey mister buy me some beer" he is put in a situation not of his choosing and is enticed to buy the kids beer because he cant say no. THAT is entrapment.

On the other hand, Gravis sees some Westfields Cheerleaders at 7-11 and says "I got beer, lets party!" then he has broken the law.

So, walking in or out of a 7-11 and being shoulder tapped to buy beer by an agent of law enforcement is entrapment. Approaching an agent of law enforcement and offering to buy them beer is not.

ENTRAPMENT - A person is 'entrapped' when he is induced or persuaded by law enforcement officers or their agents to commit a crime that he had no previous intent to commit; and the law as a matter of policy forbids conviction in such a case.

However, there is no entrapment where a person is ready and willing to break the law and the Government agents merely provide what appears to be a favorable opportunity for the person to commit the crime. For example, it is not entrapment for a Government agent to pretend to be someone else and to offer, either directly or through an informer or other decoy, to engage in an unlawful transaction with the person. So, a person would not be a victim of entrapment if the person was ready, willing and able to commit the crime charged in the indictment whenever opportunity was afforded, and that Government officers or their agents did no more than offer an opportunity.

So let's say that I, under no circumstances, am willing to buy alcoholic beverages for someone under 21 years of age. Then, is the individual who solicited me to do so breaking the law by attempting to get me to break the law?

Don't be silly, GMUHokie. How is trying to convince someone to break the law a crime? Unless there is coercion involved...

I don't like the program, but I believe it works. I would normally hook up most people who tap me, but the consequences aren't worth it for some shithead kid.

According to your logic, if I ask someone to kill my wife, I haven't broken the law if no coercion is involved.

Just to fuck with them I would go buy root beer and play it off with a fake accent and say I didn't understand what they meant!

It's getting a little hairy now! I am going to have to stand firm and say that just asking someone to kill your wife is not against the law. Paying someone to do it or coercing them is a different story.

Edit: I want to add that OFFERING to pay would be against the law too.

Three guys are applying for job with the CIA. They got all the way to the final test.

So the first guy walks into the directors office and sits down. The director reaches in his desk and pulls out a pistol. Lays it on his desk in front of the guy. Tells him, "This test is to test your loyalty. Take this gun and go up the stairs and go into the first room on your right. Your wife will be in there. Put a bullet in her head." The guy looks at him and says,"no way." So the director says, "You fail."

The next guy comes in. The director tells him the same thing. Guy picks up the gun and head for the room. Comes back about 15 minutes later. Tells the director that he just couldn't go through with it. The director says, "you fail."

So now the third guy comes in, same scene. Guy heads up to the room. The director hears 3 shots, followed by a whole lot of ruckus (glass breaking, funiture getting smashed). Guy comes back in all beat up and his clothes tore up. The director goes, "What happened to you?" Guy replies, "After three shots I realized that there were blanks in the gun so I had to beat her to death."

"I will give you $10 and you buy me beer because I am underage". That would fall under contract law. Unfortunately, an illegal contract can not be legally enforced. You can not sue someone for agreeing to steal your car for insurance fraud and then backing out of it. Same principle.

Technically, it may be fraud, but wholly un-prosecutable because of the same principal.

Perhaps, taking the money and running would fall under the "being an asshole" category. Unfortunately, that is not a crime or most people at FXU would have life sentences.
