Ok i have a driving question, I am pulling out of my road onto a main road with a speed limit of 35, I can see a car about 150/200 yards away so i pull out into the opposite lane, as i am pulling out the other car is doing about 65mph and does not slow down (maryland plates). I had to pull into the incoming lane as the driver speed past, not slowing down, or there would have been a crash.

should i have waited for a completely clear road? and also, did the other driver have the right of way regardless of the speed they were driving at.

Road is not clear, and you cannot accurately gauge how fast he was going.

i dont think it matters how fast he's going, he still has the right of way. figures for some one from maryland though.

I doubt the driver was actually a Maryland resident, the person was cheating on taxes..

Technically, the speeding vehicle would forfeit the right of way. However, since the police officer typically wouldn't witness the crash, there has to be some way of proving the speed was unlawful. Also, despite what the law says, some courts tend to believe that a reasonable and prudent person does not pull out in front of a speeding freight train, either. Your best bet here, as always, is to wait until the roadway is clear.


§ 46.2-823. Unlawful speed forfeits right-of-way.

The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which he might otherwise have under this article.

(Code 1950, § 46-238; 1952, c. 666; 1956, c. 533; 1958, c. 541, § 46.1-221; 1985, c. 218; 1989, c. 727.)

Also, on a personal note regarding this..it is REALLY irritating when someone just pulls out in front of you and takes forever to speed up causing you to have to slow down. Not to mention it is also pretty inconsiderate, yet fairly common around here.

Maybe he had tinted windows and did'nt see you

There are ways for the cops to tell by how much your car has been destroyed and can calculate the approximate speed of the car that hit you.

BUT...Its a freaking headache to deal with an accident. Just wait to pull out next time. Who knows, guy could be packin some heat and decide that it was just your time to go because you cut him off.

Rules don't work to well on our roads..use your common sense.

piss off, you own the road do you, so on a busy road you wait until there is no traffic before pulling out

You wait until the road is clear. You cannot guarantee that the other driver is paying attention or even knows what the fuck they're doing.

I apparently drive like an old man, but I've also avoided quite a few accidents by doing so.

#1 rule of driving: pay more attention to what everyone else is doing.

Actually, this is the kind of question that comes up in the driver's test. Shouldn't everyone who has a license know this?

just like people are supposed to know solid lines are not to be crossed

there was some stat i heard on the radio yesterday i think about what % of people would pass the test if they were given it now... it was bad whatever the number was.

are you saying 50% of people would fail the US drivers test. I do not believe it. my test involved driving for 10 (ten) (TEN) minutes. the problem is wankers driving to fast pure and simple

I did the test on the computer - example question, which arm do you raise to indicate if needed in addition to blinkers (or something) errrrrrrrrrrrrrrrrr

Precisely. They need to be dumbed down so that all of our "new neighbors" from Central America can answer the questions through their translators. We wouldn't want to deny them the privilege to drive or anything like that.

yeah or deny them the ability to crash into my car. when are they banning mobile phones in cars here
