ACLU Sues FCPD Over Tracking Residents License Plates and Logging Movement

The American Civil Liberties Union (ACLU) of Virginia has filed a lawsuit against the Fairfax County Police Department for what they say is unlawfully storing massive amounts of license plate data collected using automatic license plate readers, according to a news release from the ACLU.

Filed in Fairfax County Circuit Court, the lawsuit is being brought on behalf of Fairfax resident Harrison Neal, who, the ACLU says, discovered that his license plate had been scanned twice in one year and stored in a database, even though he wasn’t part of any police investigation.

The suit claims that in keeping data and location information for thousands of vehicles, including Neal’s, FCPD has violated Virginia’s Government Data Collection and Dissemination Practices Act (the “Data Act”).

“The Department’s ALPR database can be used to discover the location of thousands of vehicles at a particular date and time,” said Rebecca Glenberg, ACLU of Virginia legal director. “It is an unacceptable invasion of privacy.”

“The Data Act is very clear,” she said, in the news release. “Personal information cannot be collected, stored, or disseminated unless the need for such collection has been clearly established in advance and the information is appropriate and relevant for the purpose for which it was collected. None of this is true of the thousands of license plate numbers stored in FCPD’s database.”

One would think that Fairfax County residents would get tired of paying higher taxes simply because of the stupidity of their police department. Three million for the shooting of John Geer after complete stonewalling by the cops and now maintaining information on county residents' driving history and sharing that information with D.C. and Maryland -- all in the face of a contrary ruling by the state's attorney general. One wonders what else the county cops are up to? You certainly cannot trust them to tell the truth or protect the privacy rights of county residents.

But, then, perhaps they are simply following the lead of the county executive: stonewall and lie.

To keep concealed carry information from Maryland and their lousy apple polishing bridge cops who get CCW info from a mere license plate scan then harass law Abiding Virginians who are not carrying any firearms into Maryland.
Pulling them at 56 mph and tossing their cars in a vain search for no gun found.

This said most Md Police are good cops just like Va. But a few bad apples ...

McAwfull The Default Gov of Maryland who does not represent Va. Vetoed a bill passed by 2/3 of the Va State House and almost 2/3 the Senate.

Its one thing to get certain info from a plate scanner such as valid plate not expired. As far as CCW info that should only go out if the actual drivers license is read.

McAwfull could have altered this bill, he chose to represent Maryland.

The license plate data is only kept on CCW holders. It is n the CCW permit. Any permit holder agrees to have his\her movements tracked in VA. Read the CCW permit application.

My related question-

Does the ALPR also "know" if your inspection is expired/rejected? Or does the cop have to physically see it or pull you over for something else first???? Or can they tell simply by radio-ing in your tag #?

I rode past one today and am scared- I'm taking my car in tomorrow for inspection- it says 04/16 on the windshield and I know I need to replace a headlight (I don't drive at night) to pass but I only get paid once a month on the 28th and already spent April's pay (April 28) on paying my mortgage and other bills!! Tags are renewed, I could afford one (the tag renewal, which was $75) or the other so I chose tags since they stick out more....

i do think the plate tracking law is fine only if used for tracing FELONS who have missed court

however i have a vote of ZERO CONFIDENCE in IT "technology" being able to serve in that capacity

the information would be sold, leaked, "stolen" (sold by corrupt counties run by illegals like fairfax), used for advertising, used for harassment - especially un-Constitutional legal harassment by counties to threaten people into paying more tax and also getting their vehicles seize for police auctions, and so on

IT people to date get a ZERO for proffessional work, and F. legal communities are getting F's on equal access to courts (citizens suits against gov v. gov suits against citizens)

Add to this the aircraft with fake cell phone towers.

They're already tracking and retaining everything. It's easy to retrieve it after some event they're get interested in. Like when they want to know everyone who attended a county commissioner's meeting where the citizens got too uppity.

I have actually seen inside one of those boxes. Mostly empty. Appears to be a somewhat standard relay rack inside (from a glance it looked like a 4-post 19"). Mostly empty space but then again that enclosure is sealed for NEMA and weather compliance so it needs space to circulate air.
