Anonymous Fairfax Underground Posters Inspire New Law that Aims to Help Victims of Online Defamation!

Governor Terry McAuliffe has approved a new law to make it easier to sue online mudslingers.

The governor’s March 16 signature will add extra time for victims of anonymous Internet defamation to learn the identities of their tormentors.

The current one-year limitations period for defamation lawsuits can operate as a bar to litigation.

The new law arose from an ill-fated defamation suit Fairfax attorney Andi Geloo brought against anonymous posters on Fairfax Underground.

Virginia's one-year statute of limitations elapsed before Geloo was able to identify the posters.

Although filing suit ordinarily tolls the statute, filing against "John Doe" defendants does not.

Geloo approached Del. David B. Albo (R-Dist. 42) about the "loophole" in the law that ended her case, and helped to draft the legislation that has now been signed into law.

As internet law commentator Jonathan D. Frieden explains:

The reform should make it easier for victims of Internet defamation to recover for damages resulting from such conduct. Federal law provides a broad immunity for website operators that publish statements crafted by third-parties, so a victim of Internet defamation typically has no recourse except against the individual posters who created the content. Most of those posters post anonymously, so plaintiffs have to engage in some sleuthing to discover their identities within the year provided to bring suit. Virginia's new law gives those plaintiffs some breathing room, as long as they are diligent.

"So what can an awesome personal injury and medical malpractice attorney that really understands tort law do for internet defamation claims? Well, he can point all the claims that are barred by statues of limitations. An individual can't make claims in 2015 for statements that were made in 2012 and 2013 for starters." - eesh

Well, they were defamed as early as November, so neither of these things matter since it will stick either way since the lawsuit was filed before the statue was over.

i think the governor should investigate if NY,NY is aiding and bedding Samsung to smamboozle Apple, stealing their patents and strong ARMing apple into a tight spot

that when they were an all american %100 hardware + %100 software company before NY and NJ got their hands in the finances and deals (ie, in bed with microsoft/china)

A Virginia defamation lawyer recently noted that "the Internet makes it easy for tortfeasors with a little bit of technical know-how to conceal their identities and cover their tracks using special browsers, virtual private networks, and proxies."

As a result, "a barrage of false and harmful statements" by anonymous posters has brought about an "abundance of claims involving Internet defamation."

Much the same can be said for recent increases in the number of incidents of "real-life" harassment by online predators in the form of SWATTING, stalking, and other malicious activities.

With the enactment of computer harassment and revenge porn laws, and the extension of the limitations period for online defamation claims, the Virginia legislature has recognized for need for the law to keep up with new forms of crime and civil wrongdoing enabled by new technologies. Clearly, this is one of the "felt necessities of the time."

Yet there remains a gap between the evolving protections of the law, and the faster-evolving methods and schemes of online predators.

Who will close that gap?

Who will, like a bridge over troubled waters, lay himself down?

Who is the man who will strike down online predators not with the bloody sword, but with the strong arm of Justice?

Not in Trial by Combat, but by Rule of Law.

was somewhat excused by historians because at the time farmers were using LEAD to sweaten wine made for the politically wealthy. those who drank more became sterile and murderous - and nervous - all symptoms of lead poisoning.

recent Virginia code, since about 1998, 2007

often reads like a public threat against civilians and an excuse slip for gov workers to get away with about any crime that matters: money crimes, and political imprisonments

which is all that matters to people with such controls
