Darwin will soon be convicted for the murder he committed. Oh sure, there will be a long drawn out appeals process. Doesn't matter.

On one side you have all the resources of law enforcement and the state. And public opinion. There are many law enforcement and prosecution personnel who get paid to follow the evidence, and convict and punish Darwin if that's where it leads. They do their job and go home at night. They will work on the case for years if necessary. And someone will pick up and carry on if need be. The forces against you Darwin are overwhelming and relentless.

Jaime Ayala can't avoid culpability by merely claiming to be the driver.
