Hey all you legal beagles......... as executor of a will, can I ignore some of the bequests and get away with it as long as no one complains? One of the beneficiaries doesn't want her money and says I can do what I want with it.

If you do whatever you want with it, the other beneficiaries will (successfully) sue your ass off. Get an attorney.

I think they have to write a letter to the executor if they want to give up a claim to any piece of the estate they're entitled to. When you give an accounting of the estate, you have to provide documents showing you've transferred assets to the beneficiaries and the letter would be included.

Money Grubber-Go see a lawyer about this. Worst case is that you spend a couple of hundred dollars of the estate's money. Best case you can avoid a large number of hassles.

As executor you have certain legal and fiduciary responsibilities for handling the will and the estate of the deceased. This includes knowing that when you do not clearly know the legal answer to something, that you MUST bring in a competent lawyer for legal advice.

A court representative has to recognize the will as valid and recognize you as the valid executor. You cannot just unilaterally rearrange or reallocate the bequests in a will. You must formally notify all parties if they are mentioned in a will. If someone wants to forgo receipt of their bequest in a will it has to be formally disclaimed and that has to be legally documented and recorded.

Please - contact a local lawyer ASAP.
