Concealed weapon permit needed?
Posted by: OG ()
Date: April 04, 2009 10:48PM

Is it illegal to have a baseball bat in your car if you don't have a glove & aren't on a team? Is it illegal to have an axe in a car if you don't have any logs as well?

When is a permit needed?

AFAIK Virginia only Issues a CHP - Concealed Handgun Permit - so that does not cover any other type of weapons.

There are no regulations on carrying axes or baseball bats. People freak out when I take my axe or baseball bat to a bar or to Safeway. Axes don't kill people, people kill people. I should be able to take my axe with me to any Safeway, school, business meeting etc... When people see me carrying the axe they freak out. That is jut silly, I need the axe in case there is a thug around!

If everybody carried more axes there would be no crime! It is my right to carry my axe every place I go! If people don't like that then are fucked up in the head!

I think it's wrong that I can carry a handgun openly, but I can't carry a samurai sword around. This distinction is discriminatory against feudal japanese warriors.

I carry my battle axe with me at all times, in meetings, shopping at the grocery store, church... You never know when you might need it.

The can have my axe when they pry it from my cold, dead hands! If they outlaw axes, then only outlaws will have axes!

If I replace my wood handle for a black polymer one, does that make my axe an assault weapon?

The NAA says no! If you looking for polymer tipped axe handles you should go the Dulles Expo Axe Show.

No, unless it is used for scientific purposes or doesn't work (i.e. ornamental).

I think you're talking about a "hatchet," which is all a sawed-off axe really is.

If you're talking about stopping power you need to carry an axe. You'll never find me carrying concealed hatchet.

Just make sure you don't carry while hunting:

§ 18.2-141. Cutting or destroying trees; carrying axe, saw, etc., while hunting.

It shall be unlawful for any person while hunting for game or wildlife on the property of another to carry any axe other than a belt axe with a handle less than twenty inches, saw or other tool or instrument customarily used for the purpose of cutting, felling, mutilating or destroying trees without obtaining prior permission of the landowner. Any person violating the provisions of this section shall be guilty of a Class 3 misdemeanor.

On a serious note, The Supreme Court of Virginia just ruled that a butterfly knife isn't a prohibited weapon (prohibited from concealed carry without a permit, and only handguns have a permit).

http://www.courts.state.va.us/opinions/opnscvwp/1080445.pdf

I'm sure the legislature will be amending the law at some point but Shhhhh!

Here's what you're not allowed to carry concealed:

§ 18.2-308. Personal protection; carrying concealed weapons; when lawful to carry.

If any person carries about his person, hidden from common observation, (i) any pistol, revolver, or other weapon designed or intended to propel a missile of any kind by action of an explosion of any combustible material; (ii) any dirk, bowie knife, switchblade knife, ballistic knife, machete, razor, slingshot, spring stick, metal knucks, or blackjack; (iii) any flailing instrument consisting of two or more rigid parts connected in such a manner as to allow them to swing freely, which may be known as a nun chahka, nun chuck, nunchaku, shuriken, or fighting chain; (iv) any disc, of whatever configuration, having at least two points or pointed blades which is designed to be thrown or propelled and which may be known as a throwing star or oriental dart; or (v) any weapon of like kind as those enumerated in this subsection, he shall be guilty of a Class 1 misdemeanor.

Nice! I still have my butterfly knife I got from that cool Asian shop that used to be in Springfield Mall in the 80's. They sold butterfly knives, shuriken, and lots of posters. Now I can carry it around just like the old days when being harassed by mall cops.
