ALEXANDRIA, Va. (AP) - A judge will hear arguments from the federal government that a constitutional challenge to its No Fly List should be tossed out of court because it would expose state secrets.
A Virginia man, Gulet (GOO'-lett) Mohamed, challenged his placement on the list in 2011 after he was temporarily denied permission to return to the U.S. after traveling to Yemen.
Mohamed has won several pretrial battles, but earlier this year the government filed to dismiss the case by invoking its state secrets privilege. Essentially, the government says details of the case are too sensitive to be exposed in court.
Multiple challenges have been filed to the No Fly List, but this is the first in which the government has invoked the state-secrets privilege.
