Driving After Illegally Consuming Alcohol... a significant misdemeanor?

Hi All,

I'm reapplying for my Deferred Action for Childhood Arrivals. I would like to know if a Driving After Illegally Consuming Alcohol would be considered a 'significant misdemeanor' as a DUI or DWI would be?

Were you under 21 and got caught drinking and then driving? Then yes, its the same as DWI basicly.

Yes, I was under 21 at the time. The Driving After Illegally Consuming Alcohol does not pose any time served/ no time suspended whatsoever. Would you still say that it is still a 'significant misdemeanor' as a DUI or DWI would be?

I got the same charge too.

It is not a significant misdemeanor, If it was prior to (2012?), they recently changed it from a class 5 to a class 1 misdemeanor.

So if you got it prior to the change date (2012 i think), you are fine.

I remember in my case, my lawyer did not want to get it changed to a reckless driving as that charge was worse than the original charge.

Well it was after 2012. In this case, the charge does not pose any time served/suspended, but I think may still be a class 1 misdemeanor. Still a significant misdemeanor though?
